Should men who are falsely accused of rape and other sex crimes file defamation lawsuits against the accusers?

They can, but most people are "judgement proof". You can sue them, and possibly be awarded damages, but you can't collect because they have no assets that can be seized. I don't know about other countries, but in most of the US you can't take their home, or their car, and in some states you also can't garnish their wages.

Generally in the US attorneys taking such cases work on a contingency basis. The plaintiff pays nothing, but if the suit is successful the attorney receives one third of the judgment. If the defendant has no assets, attorneys won't agree to work on the case.

Also knowingly making false statements to the police or other government entity is a crime. This includes false criminal accusations.

This is the same thing as men being falsely accused and going to jail for things that they haven’t done that were actually fighting for right now. Only issue is they probably would not get their reputation back because of this type of case, and with social media that’s a hard thing this is a big if

it's an eye for an eye justice. i wouldn't say that everyone would take that. that would be stupid. almost no guy would take that. but to ruin a guys name to such an extent the punishment should fit the accusation.

i'm not cold-hearted. these people are mentally ill or being controlled possibly. defamation is not enough in my opinion.

We already identified the problem is in the accusation yes
But to sit there and let somebody rate someone is beyond off the charts and on top of it if they end up doing the crime, then they just go back to jail because if you’re really thinking about it, you’re not actually giving me a chance your introducing a problem

i think i agree in a way. and that's the point. you can't do this. you can't falsely accuse. you ruin a persons life when someone was accusing you of the same.

in a twist. she could serve out the sentence of what he would have to serve if he had committed such an offense against her. i think that would be very fair. add on to that the defamation sentence.

My concern here is real rape victims wouldn't come forward out of fear the courts wouldn't believe them and their rapists would sue them.

I definitely think their should be reprocussions for lying but this should be handled by the police as a criminal act and not through private prosecution

Yes, it would make women who are lying fearful to start the process and they should be fearful since it is a horrible crime to lie about this. For those telling the truth there is nothing to fear.

We do not ignore crimes in the service of permitting yet another crime.

Public prosecution for a crime AND private prosecution for defamation are both appropriate and should be pursued concurrently.

It will usually amount to more costs, amd be seen as vindictive, to boot.

This is why the Western laws around rape prosecution are so fucked up. Whether accused rightly or wrongly is irrelevant as most will makeup their minds irrespective of establishing facts. Hence naming both parties before court judgement is stupid.

Here's the problem. False rape accusations are rarely proven to be such. That's because the vast majority of false rape accusations never make it to trial because the charges are just dropped due to lack of evidence. Law enforcement knows it is very difficult to prove a false accusation, and they don't have the resources to investigate every rape accusation they know damned well is false.

Yes but not just that. The accuser should have to serve prison time equal to what the man would have had to if he had actually done what she claimed. Maybe even longer for intentionally trying to ruin his life.

They should, but I suspect most guys want to move on and get away from the thing that destroyed their life. Most don't want to chase after the insignificant money they might get from the person who's likely broke af anyway. What they should do more of is file criminal charges. If there is strong proof, the sentences should be harsh.

Yes. There has to be some sort of repercussions. The problem is with most rape cases it's usually a case of her word vs his, almost impossible to prove either way.
