Before one can answer this question, we need to established what the criteria is that would be used to say she falsely accused a man of rape.
For example, if she says someone raped her but no charges are brought, is that a automatic she must be lying because there isn't enough evidence so charges are brought against her for a false allegation?
Or it goes to trial but comes back as not guilty because she is too traumatized to testify, does a not guilty mean he didn't do it thus she falsely accused him and now will be tried for falsely accusing him?
Thus the system sends a rape victim to prison?
If it can be proven by a recording of a woman stating (say secret video recording) that she admitted to falsely accusing him for whatever reason, I would say that is good evidence but there is still a problem even with that. She could have been pressured or threatened to record that video under duress.
Women get threatened into recanting all the time, many here will say if she recants it was a false accusation to begin with. Thus she should get the prison time he would of gotten.
Only those deeply involved in the system, as a victim or rape understand this. I've been raped and I volunteer at the rape crisis center when I can.
Many are terrified to testify and simply are unable to, my 1st attacker raped 12 girls, but only 3 of us could face him in court. Of the 12 over half killed themselves later.
The majority of rape victims are afraid to even report it to the police for fear of not being believed.
The real problem with punishing women for this though is, lets say someone was truly raped and the man threatens her to not report it or else he'll get her convicted of falsely accusing him of rape and sent to jail instead.
She reports it. He pressures her and threatens her to recant and other methods, she recants and then he pushes for he to be charged with falsely accusing him because his reputation was damaged.
Not only would a real rape victim be sent to prison but it would make even less women report their attacks, it would be open season on raping women as most would be afraid that if they reported it they would go to prison if they aren't believed. As it stands now most don't think they'll be believed anyways and police already suck at investigating rape.
This is an example of how bad police F up rape investigations https://ksltv.com/528602/rape-cases-involving-same-suspect-wrongfully-closed-getting-new-look-after-ksl-investigation/
When it takes the media to get involved to make the police do their job.
Now the real question is what would it take to determine someone falsely accused someone? Then we can answer your question.

It's hard enough to prove rape/sexual assault happened in a lot of circumstances. You think they can prove it didn't happen?
Sure if in cases there is undeniable proof that someone has falsely accused someone of SA then they should be prosecuted. Conspiring to bring false accusation is 3 years imprisonment no more than 14 here in NZ.

"What should happen to women who falsely accuse men of rape and/or sexual assault?" If t is proven that she made a false report, with the same procedural protections/fair trial given to her, she should be subject to the same sanctions that would have been applied to him if he had been erroneously convicted.
"Also, do you think the men accused are innocent until proven guilty?" They SHOULD be innocent until proven guilty, but that legal presumption has very little significance n the court of public opinion, and especially when the accusations are either sexual assault or child abuse.
I believe women that do false accusations not only be condemned, but should serve the prison penalty that would have befallen the falsely accused man had he been found guilty. Only fair a false accuser gets an equal punishment.
It serves as a deterrent to keep false allegations from being had, but also gives more transparency. It does a disservice to women who were truly victims because if it surfaces as false later, it only discredits people from coming forward as well.
I am a believer of the phrase innocent until proven guilty.

Innocent until proven guilty is irrelevant to the mob mentality of the public as informed by the media. Therefore, false accusations should be tantamount to manslaughter to impress upon the female gender the importance of not ruining a mans life, until such time as tue legal system can say with confidemce that such false accusations have decreased, consequently allowing for a reduced punishment, say serving time for assault. The media should also face charges if they report an alleged sexual assault because they do so for rating s at the expense of personal lives. LIBEL 125%. Having said that, because I know some extreme women will flip out, current actual rape cases should be sentenced much harsher, say, also tantamout to manslughter. Anyone I didn't piss off? No?
Good.
She should ideally receive a similar sentence to what the man would have if he was convicted.
But an important thing, there has to be a distinction between someone who actually have a false accusations and someone who's accusation couldn't be proved. Its very common for rich and powerful people to get away with such crimes using their power and influence, the victim who was denied justice shouldn't be sent to prison simply cause the accused used their money to cheat. I don't know how that distinction can be made so maybe a prison sentence may not be the best idea then.Innocent until proven guilty...
If a woman falsly accuse a man about such things, she will end up in prison with hard work!
I don't if you're a woman crying and nagging about being raped, unless it was real than he will get a severe punishment which will make him regret the moment he did it and if you were playing the victim against an innocent man, i'll make sure to turn your tears into bloody tears!
Call me what you want but that's me and i'm proud!
You ain't gonna get any remorse or pass just cause you have a vagina, you're innocent i'm on your side, you're a victim, i'm on your side but i'll become a beast against a criminal or any dangerous false accuse!
Here's a case where the woman falsely accused 8 men was charged with 8 counts of 'Perverting the Course of Justice' found guilt on all charges, she should have received a sentence of 28 years (36 months x 8) but the Judge cut it to 8 years (1year x 8) no reason given.
news.sky.com/.../eleanor-williams-sentencing-three-men-tried-to-take-their-own-lives-over-womans-rape-lies-court-hears-12833303If the man is found not guilty without any doubt. He will still serve a life sentence because of all of the negative publicity that the news media gives him prior to the trial. Since they do not publish the women’s information prior to and even post trial. Her information needs to be plastered all over the news so other guys can stay away from her. And for good measure. She needs to serve prison time equal to what the man would have received!
I know women will say this will prevent rapes and assaults from being reported.1. Not able to convict of a crime is different then a "false accusations claim."
2. A "false accusation claim" needs a level of evidence of the crime.
The crime is called perjury. A person convicted of perjury under federal law may face up to five years in prison. Perjury also carries fines and probation, depending on the context and the severity of the crime.
They should get the maximum sentence possible for the falsely accused, have to have a national registry for false accusers, and have to pay to support the man financially until he can get a job like he had before the false accusation, because even after proven innocent, it can still be difficult to get another job due to ignorant people that think "there is no smoke without fire."
Innocent until proven guilty, unfortunately women pushing this metoo stuff would prefer that there was no due process and they're happy with this frontier justice of online slandering and condemning.
They should get community service and should pay a fine back to the person they falsely accused.Innocence should be presumed but never is. The accuser's identity is protected but the accused's is not.
Where I am a woman got and elderly gay guy killed but running up to a couple of asking them to help as she had just been raped. So she got those guys convicted of murder as a consequence.
She didn't face a single charge for inventing the rape story despite it being a lot worse than merely a false accusation of rape.
Yes there should be penalties. What should happen to women who falsely accuse men of rape and/or sexual assault?
*If it can't be proven other than "her " word, Jail time for fraud.
Also, do you think the men accused are innocent until proven guilty?
*That's what the Constitution says.Everyone should be innocent until proven guilty but in the eyes of the public they aren't always. There was a teacher who was shunned for molesting two school girls and when he killed himself the two girls confessed they made it up because he gave them detention.
False allegations are worse then actual rape, so the women should a get a longer sentence then the man would have been given for the offence. In the UK rapists typically get on average 8 years in jail.
Also the accused is innocent until proven guilty but for all sex offences they should remain anonymous until proven guilty.
This is what this woman said that she was raped and groomed it was all lies and now she’s in prison.
She’s ruined someone’s life so she should go to prison for lying.
BBC newsWomen should be charged if they knowly falsely charged a men. Yes in our system we are all innocent until proven guilty, by a jury of our peers, but unfortunately the media and the public opinion will find you guilty with a lie, before the truth has even been told.
I would say they should get heavily fined or face prison time but then that’d discourage the real victims from coming forward. There’s no real good way to handle that situation.
A woman who is caught lying about it should face the same time as what would of been given to the man... Yes I believe everyone is innocent until proven guilty...
Women who falsely accuse should be given the sentence that their would-be victim would have gotten. And I think in terms of legal justice, yes everyone should be innocent until proven guilty.
Women should face charges if they falsely accuse a man of rape. Simple as that. Through that one accusation men’s reputation can be ruined, they may lose their loved ones or their job.
They should be jailed for an appropriate length of time.
Anyone is innocent till proven guilty of any crime. There is a discussion to have over anonymity, peoples lives are destroyed by accusations.I think they should get the time that the man would. But, that will never happen, especially today. And yes, men are most often considered guilty until proven innocent.
