hard to make decision without viewpoint of others as to how scary of situation that is. Most situations I've seen on trains did not warrant attacking from behind and holding down.

I'd bias towards some jail time since Neely only was verbal, not physical and brandished no weapons. But... I did not hear his speak or tone...

@Ladsin2 I did alittle research. It turns out that guy who died and accused of verbally harassing others on the train had sczhiophrenia. Sczhiophrenia is considered the most severe mental illness. It’s possible he may have not understood the gravity of his actions.

@Opinion owner Yes, exactly. It wasn't Penny's job to give a psychological exam. It is illegal in the US to threaten people with physical harm, you can be charged and convicted of it. An example is law enforcement. You can definitely scream at them during an encounter and call them vulgar words but once you threaten them, you will get arrested and they can use force to do it. The people on the subway weren't just "scared", they feared for their lives! They told authorities that and they testified to it in court. It was also a mixture of races that praised Penny and also helped him hold the suspect down. Race isn't an issue but SOME people can't see past race.

The issue is that saying that you didn't like what somebody was saying and felt afraid of what they were saying is not an excuse in a legal sense for then assaulting them and killing them, which is exactly what happened here. This is not an issue of protected speech in that it was not a government agency that attempted to suppress Neely's speech. Protected speech is a civil rights concept and this is not and was not a civil rights issue.

I said that Neely was killed for his speech because if he had not been saying the things he said it's possible that Penny might not have assaulted and killed him. We don't really know one way or the other because that isn't what happened. What happened is that Penny wanted to play hero and assaulted and killed him. I contend that based on Neely's behavior there was absolutely no indication that he was going to kill anyone or injure anyone. He was just mouthing off.

As in aside, I see this sort of behavior all the time from people with schizophrenia when they get agitated. Granted this occurs in a controlled environment, but these people do not require physical intervention in order to get them to stop.

Daniel, Penny didn't know this and I wouldn't expect him to know it, but he should have known better than to physically intervene with someone who had not harmed him or anyone else that he had seen. I guess his need to become a hero overtook his judgment and good sense if he had any to begin with.
