Rape is considered one of our most serious crimes and carries a high penalty. However it remains one of our most common crimes.

But it has a low conviction rate, many victims do not come forward out of not being believed, those who do undergo intense integration only to be told there isn't enough evidence to prosecute, those cases that make it to court have an up hill struggle to prove their case.

The past few years have seen some high profile cases where victims went for years without coming forward out of fear of not being believed or being leaned on to keep quiet.

Being told," No one will believe you," has long been the threat of countless rapists. But now there's calls to prosecute victims who fail to make their case in court. Rape isn't about sex, it's about power and I think moves to allow rapists to prosecute their victims are not about protecting the rare falsely accused but about discouraging victims from wasting police time on unwinnable cases.

I believe they are not being pushed to protect the innocent but as a weapon for far right misogynists looking to create a rapists charter, "Tell anyone and you will be prosecuted."

I disagree, and it's not because I think you're wrong about it being potentially abused it very well could be any law can be abused. Yes, many rape cases go unreported because of fear, lack of evidence, power dynamics etc. but there are also a lot of cases of woman lying about it getting caught and not giving a single F.

I spent time in jail because a woman my friend at the time was in love with said a guy tried to rape her and robbed her when he failed. We got together to scare the shit out of him and teach him a lesson by robbing his car only to find out she fabricated the whole thing to rob my "Friend" and she didn't want to get caught.

She got off with a slap on the wrist because she got pregnant, and she got out early when she already barely had any consequences then she dumped her scapegoat baby with her grandparents and disappeared and hasn't been heard from since over half a decade later. She probably OD'd she had a hard drug problem and was struggling to stay clean. She almost died from meth multiple times.

In my opinion the second most evil thing you can do to a person instead of raping them is lying about being raped. To give you an idea of how evil I find this murder is tier 3 on the evil teir list with cheating and abuse being pretty much tied for being 4th.

Women deserve justice for being R'd 100% but men deserve justice when they are falsely accused because being labeled a rapist is a stain on your reputation that never goes away. If I was fighting a rape charge after being false accused even if I had no prayer of winning the case I'd deny it even if it would get me out sooner to plead not guilty because I wanted on my record if I lose when people ask that I fought it every step of the way because it's a lie.

It's a label that will ruin your entire life forever the reason I place rape and lying about it above murder is because I've seen the effect rape has on people. There are a lot of rape "Survivors" but the reality of it from what I've seen for many of them is yes, they are "surviving" but they stopped being "Alive." after it happened. It's spiritual and emotional murder.

Thus, this is why I have lying about rape as number 2 because it ruins the falsely accused life forever and it also de-values and casts doubt on all rape cases that actually did happen making it harder for real victims to get justice.

Yes, there is potential for abuse of the law here but there's ways to abuse every law and it's not a fair system if one group gets special legal advantages, privileges and defenses that another group can do nothing to contest when falsely accused. We have a "Legal" system not a "Justice" system because justice is impossible to provide efficiently through the law because justice is contextual, but the law is universal.

Hmmm “failed rape cases” well it depends on why they failed. Was it not enough evidence? Was it the character of the alleged victim? Or alleged rapist? There can be many reasons for a conviction not to stick or sentence vacated but not all or majority should ever result in the accuser being punished for alleging the offence

I would agree that if the alleged victim is found to have lied and this alone led to a person or persons being charged then yes they should themselves be charged at least with attempting to pervert the course of justice.

The problem is however that a false accusation of rape is extremely damaging , life affecting or even life ending regardless of the fact a conviction wasn’t obtained so some would agree there has to be consequence or at least deterrent for lying as the sole purpose would be to cause them harm emotionally , reputationally or in any way possible.

I remain however that the present system basically policies itself , although somewhat unevenly at times. Many sexual assaults and rapes go un-reported and unpunished in terms of the assailant and so the cards are already stacked against any would be victim. Charging the accuser unless proven to be lying would be a derailment of our justice system

The world isn't black and white. It depends on the individual case. I'm sure both things exist, but only people involved will know the truth.

But I do agree that if you have the power and money, showing people like... "Hey I'm coming after you if you try shit" is something that is probably happening a lot. But that doesn't mean that every failed rape case is that. It depends on the evidence.

I think if a court comes to the conclusion that there is no evidence backing up the claim, then it's something we need to accept and not pretend like they said otherwise. But if it's just a lack of evidence or because it has been a long time ago, there will always be some bad aftertaste

When i was raped for months n months... people made me feel as if i was the one at wrong n it was all my fault... even if someone didn't side with that priest they still pushed for not to report or talk to anyone about it... n i was told exact same thing... that he is a priest n has such a prestige position... no one is going to believe me... they said if i was being abused why did i remain silent for months n let him keep on... but thats the thing... he was manipulating me using that very position n trust i had in him n religion...

My response: Yes, because mathematically yeah whatever men/women agree or disagree with have the statistic capabilities of being a sex criminal. Though I do believe a certain ‘demographic’ of society tends to defend the perpetrator more than the victim when it comes to such heinous crimes even when there is irrefutable evidence / a conviction. Now whether or not that certain ‘demographic’ would commit such an offense or is an offender I don't know for sure and not going to throw labels around.

My stance is simply treat each case individually and not a ‘mob mentality’ or a ‘sheep mentality’. Mob being anti victim especially a woman accusing a man of rape. Sheep being pro abuser especially a man playing innocent of raping a woman. Treat each case individually and focus on the evidence also whatever the outcome is swallow your pride & admit the result. Also don’t take a court decision as Man V. Woman or whatever just see it as a legal battle, nothing more and nothing less.

Well in the UK there was a recent case of a woman buying a hammer at a supermarket (Tesco?) to hit herself in the face with in order to support a false rape claim. She was sentenced to jail appropriately.

Usually you are very tongue in cheek but I am going to assume you are serious in this instance. Do you really think the woman in this UK case should go unpunished for a fallacious claim?

Or a young woman, in my city, running out of a park to some young men screaming she had been raped - when she hadn't. She incited the young men to charge into the park and kick an elderly gay guy to death. Not even a false police report for her.

Rape is an unusual crime because sex is an activity that is commonly sought and almost always occurs in seclusion. It is hard to find another crime where the victim willingly participates in the activity at times.

I don't know if it is true or not but I have seen it claimed that women can go into freeze mode in maybe 70% of events. If that is so than it is quite possible that a man thinks he is having consensual sex whilst the woman thinks she is being raped.

In most crimes proof of a guilty mind (mens rea) is required and it is disturbing if that is removed (as it has been). If a woman doesn't say NO or oppose sex in some manner how is a man expected to know and act accordingly?

Perhaps a very much lesser charge of 'sexual recklessness' is needed if no NO is not required with a punishment of 100 hours or so of community service. Germaine Greer has advocated this though she termed it a bad sex charge.

I don't think that a not guilty in a rape trial should be an automatic guilty verdict of a false accusation. Or vice versa.

I agree that prosecuting someone for a sexual crime is difficult but I feel like this is more because of the nature of the crime and of the criminal justice system. I don't think a failed case should lead to the conviction of the accuser but I do think there should be a way to punish people where it's very obvious that they were lying.

It's a difficult situation. I think if it can be proven that the person was lying by the same standard as it has to be proven that the accused is guilty then they should be punished. Do you think that's fair?

I think that's an interesting take on the issue. However, I don't think sweeping statements like that get at all of the intricacies on the subject. I do think a whole lot of men are just angry that the Me Too Movement has gone so badly off the rails in some ways and, also, that false accusations are as prevalent as they are. Some studies dispute the assertion that false allegations of rape are extremely rare, with some showing that as many as 40% of sexual assault charges are false. So, no, I don't agree with that statement. In the current social atmosphere, I think men are justifiably gun shy about possibly having their entire life ruined by being falsely accused of something. And, it is ruining things for all of us women, too, as demonstrated by so many women asking "Where have all the good men gone?" Gee, I wonder...

The Bible prescribes a four-fold penalty for bearing false witness in a criminal trial. It doesn't' matter if it's the original accuser, the judge the prosecutor, or anyone else, if anyone is found to be falsely accusing the defendant, they are to be punished with four times the penalty of the original crime.

False accusing women are trying to ruin a man for LIFE and they deserve life in prison because of it.

The claim that false rape claims are rare is debatable, it is based on cases proven to be false. In most cases it is he said she said so only the two of them know the truth. Even if a man isn't convicted there are can still be serious consequences for him. Therefore, I am not saying that accusers should be prosecuted simply because they can't secure a conviction, but if there is sufficent evidence to prove the accuser lied then there ought to be some consequences for her/him. Had the Duke Lacrosse accuser gotten her just desserts her boyfriend would still be alive. At the same time, there should be rules protecting accusers too from retaliation from people like employers.

You make it sound like both are the same thing, it's not, there's a difference between no evidence and someone being caught out by evidence about lying about being raped and putting the man through hell.

Because he would of been arrest, possibly put in jail and even if he was on bail he would of been put through hell by people around him or women would of been causous about being near him even if he was found innocent women will still wonder so his dating life would be ruined.

I have to disagree.

I live in a country where most rape cases go unpunished (which is not right), but at the same time, of those who do get a conviction there's a significant number where guys were convicted on false charges, fake testimonies and even no evidence but a bribe or a threat from interested parties with power was given to the judge ruling the case. These are innocent people that go to jail and live a literal hell in jail. Most of them end up committing suicide...

Such a difficult situation. I have seen cases where the victim was not upset until her friends found out. Then she called it rape. She was actually using 50 shades if gray as a playbook until her church friends discovered her activities. Then again there are real cases. No one should be forced to do anything they are not willing to do. And you are right it is not about sex it is about control.

I think those cases should be taken with the most seriousness.
