There should be a penalty that is justified in the eyes of the law and will put an end to these attention seeking BS claims , though it shouldn’t be as harsh as someone who commits a totally heinous irredeemable act, should be treated on the severity of the case ig.
I once saw a little girl who faked to cops that a white van was on the road that kidnapped someone , if this case was taken literally by police and escalated , someone could’ve gotten seriously injured or killed in the process. If it was a grown ass adult who endangered a real van owner then certainly the penalty should be heightened.
Not that it is the only scenario, that it should follow that structure.Filing false cases for attention / clout / to ruin another human being’s reputation is heinous , morally wrong , and downright vile that should never go unpunished.
My only concern: How do you know (or at least prove) when someone is falsifying a forced sexual encounter / assault when they file?
Date Rape is via an odorless and tasteless drug put in the drink that dissolves quickly. Once the victim is awake , they don’t have a single memory of what happened after a certain point which once it comes up later , it can seem like a falsehood done for money or a smear campaign. Bill Cosby did do sexual assault in this manner along with other methods like sexual battery , coercing women to do sex acts using his power and influence over them , etc. in ways similar to Harvey Weinstein’s heinous sex acts which Hollywood would joke about / mention for decades before it came out.
If a ‘false’ filing is not winning your case or it not being accepted because of the higher ups…. Then who is there to stop these assholes from using women as tools and props for their own pleasure seeking ventures. Gross.

Weinstein did not do anything that other people here in Hollywood. Weinstein got in trouble because he's a very overweight unattractive man that women did not want to have sex with. He got in trouble for asking for sex in exchange for entry into the entertainment industry. Plenty of women who are now film and entertainment stars took him up on that and as a result they are multi-millionaires.

They knew about it during Monsters Inc + Shrek CGI Hollywood Award Show , they joked about how you shouldn’t go to Weinstein’s room…. Was he ever charged back then? No because he was making hit after hit until sometime when he wasn’t so, once he wasn’t useful they canned him.
Once you aren’t useful to the machine, you get justice handed to your ass.

What they really mean is it would discourage other people from filing false rape cases. That would seem to be the point of punishing people who actually file false rape cases. Feminists ignore all this and think that any woman should be able to file anything they want and be believed. This is why you can't get a marriage proposal or a date if you are a woman. No sane man wants any part of this.

10 moYes, filing false claims is an objectively immoral and cruel thing to do, especially because even when acquitted it means the man’s life is essentially ruined and he has to start all over to find a sense of normalcy again.
However, sentencing a false filing to anywhere from 10-30 years in prison, or a massive fine of anywhere from 5 to 6 figures seems inordinately excessive.
This reactionary response comes from a deep desire from people who want to punish women for using a system they didn’t make to their personal advantage. Yes, it’s cruel. Yes, they’re terrible people. Creating such harsh punishments for women who do this, in my opinion, does nothing to actually solve the problem. At least imprisoning real rapists (a crime that cannot be redeemed or fixed, these men will never change who they are and there is no cure for them once they reach that point of violence) keeps them away from vulnerable parties, even though imprisoning them solves nothing about the root cause for the crime itself.20 Reply

10 moLet's assume you've just been raped but the case collapses due to lack of evidence, how would you feel about then facing prosecution? Would you even report the rape in the first place?

I guess there is still a burden of proof it was intentionally a false claim, which likewise might collapse due to lack of evidence. I guess we have to outlaw public accusations of rape as extreme defamation attempt to ruin a persons life and have strict privacy controls around such a case to protect the accused as much as the accuser until the case can categorically be proven with evidence as true or false. Now if all that is true and it is proven beyond a doubt that it was an intentional malicious false report, then it probably should match or be worse. Otherwise you leave the system open to abuse. Now if it’s a public accusation and becomes unproven then becomes a defamation style case that’s the question then isn’t it, was there insufficient evidence and he gets away or was there insufficient evidence to prove she made a false report. If everything is kept private then there’s no long term damage done just split the costs. One might argue she chose to make it public and ruin his life and face the consequences if she can’t prove it however anyone sympathetic to the pain and trauma it causes someone would appreciate they want that to be known and may not be able to control themselves for a brief moment and make that mistake. However in many other law cases, you have to keep privacy/secrecy so as not to jeopardise the case, therefore I’m afraid to say it would probably go that way which could potentially protect male monsters if abused woman have a momentary lapse of self control but ensure innocent men are not destroyed by malicious women. Which obviously some will be relieved by and others horrified of an easy escape from facing justice. It’s complex, there doesn’t seem to be a perfect solution.

8K opinions shared on Society & Politics topic. If you mean that they should be prosecuted, yes, of course. However, if you mean that the false accuser should face the same amount of jail time, I’d disagree with that for two reasons.
First, unless the falsely accused is convicted and sentenced, you don’t know how long that jail time would be. We’d also have to define when the accusation is legally considered false- when it’s conclusively proven false or just if the charges are dropped due to insufficient evidence or there is a not guilty verdict.
What if the accuser recants?Second, as bad as a false accusation is, it doesn’t include the physical action involved in rape, so the punishment can be made for an action that did not occur.
Note also that a false accusation of rape is a tort, and a false accuser is liable for civil damages as well as criminal prosecution.

Plus, saying the same sentence as a rapist is automatically in conjunction with the false accusation. I think rapists don't receive a proper punishment. After a repost is caught he shouldn't be allowed to have the opportunity again. By whatever it takes. A bitch making false accusations should receive a minimum of 5 years before parole and that's being lenient.
10 moAccusing someone falsely of being a rapist can have terrible consequences in their professional and private life, and thus, in my opinion, people filing false rape cases should at least face a trial. Up to justice to evaluate the harm done, and how to make the false accuser pay.

A false allegation - I'm not talking about a verdict of "not guilty", rather one proven false before trial starts - can be as psychologically damaging as an actual assault. 10 mowell obviously, cause they're committing the worst form of fraud and reputation destruction possible. and it's not just that this "should" be illegal and face legal actions. it already is. i think the punishments for that should be way more bad. cause that undermines the credibility of actual rape victims that we should be helping.

Dare I say that’s because you can’t put yourself in the shoes of someone being accused of rape. So how about this, we know there are woman abusers of children. I have a feeling woman falsely incarcerated for rape would disagree with you.
I’ve heard stories about hot light bulb usage on those cell wings. Likewise if not incarcerated, good luck in society if everyone things you abuse children, even as a woman it’s likely not a life worth living.
Yes it’s a horrific violent crime, but you put someone in danger for the rest of their lives. Still why are we comparing them? They’re both bad, it’s not a competition.
