In all states, unless said spouse gets some kind of TRO, or restraining order, Said spouse cannot kick the other out of the marital home. While the police won't enforce most of the time, Its illegal to kick your spouse out without a restraining order or TRO/PFA. This also means, if said spouse changes the locks, the locked out spouse has the right to break in.
