How do I sue my abusive husband?

So we had a divorce 3 months ago and the custody of the children is mine. He keeps insisting that the kids should be with him because he claims that I’m a terrible mother who’s careless about her looks. I’m not in anyway offended by what he said because it was his decision to marry me, but what happened was basically, he just cheated on me with his 2 mistresses.

I don’t trust him to take care of the kids because he’s also abused me for years, he hits me with a mop and throws water at me when I wasn’t able to cook for dinner. Right now, he just assaulted our 4 year old daughter and our 6 year old son is scared to see his father because of his actions. As a single mom (29F), I know my responsibilities for my kids and I don’t want my husband (35M) near our kids because all of us are scared on what he might do furthermore. How do I file a case against him?

If you can afford to hire a lawyer that is the best way. But will probably start somewhere around $2000. Google "custody lawyer in *your state*"

If you can't afford that, you can sue him on your own but it isn't easy.

You would go to your general district court and ask for the forms to file a civil lawsuit. Usually need his name and address. And you usually have to fill the form out and mail it to him at least 10 days before you file it with the court.

Every state is different, so look online for a guide or instructions for how to sue in your state.

That said, I have only ever sued for money. I don't really know how to sue for custody. Might even me a different court and a totally different process.

If you can't hire a lawyer, your best bet is to Google "how to sue for custody in *your state*" and go from there.

Maybe interview your kids with a video camera about how they feel about their father and see if that is admissible in divorce court and ask your lawyer what type of evidence will count, also some lawyers work pro Bono.

It doesn't matter what kinda mother you are if your not crazy the courts will always award you custody and if you have police reports against his abuse and photos of it that will go along way and i hope you did call the police on him for hurting a 4 year old and maybe slap a DV on him
