She came to our table and introduced herself. He asked her what her name was again. He was really open to communicating with her and when the waitress is unattractive he usually ignores them. When they are cute, he usually talks to them with eye contact. Is he flirting?

Nah... Flirting isn't being nice. People are nicer if you look better in general, not only to a restaurant waitress, but to coworkers, bosses, you see it all the time.
Just being nice to pretty waitresses while being less so to uglier ones, while a bit shitty to the other waitresses I don't think is something that serious.
It turns into flirting if he strikes way too much conversation. Like if he asks way too many questions about her, even if it's about her working there. If he's trying to make her laugh everytime she comes to the table. Stuff like that is flirting, asking someone to repeat their name if you didn't hear it? Ehhh not so sure

It could be considered flirting. I ask the waitresses their names all the time simply because it feels inappropriate. I mean if she’s serving our food I feel better knowing their name rather than just waitress. So impersonal like she’s not a person. Plus if I want to tell her manager what an exceptional job or lack there of I know their name. Also if it’s a place we frequent I tend to ask for the same waitress by name if I know she provides exceptional service because she knows what we like or don’t like from previous encounters. Now if he’s simply asking the waitresses who are pretty their name than say I’d think he’s flirting.
