It's not still legal. It hasn't been legal in Canada since October 2010.
That said, no one seems aware of the law and Health Canada is not enforcing it.
The Canadian federal government says products containing salvia divinorum and its active ingredient, salvinorin A, are considered natural health products and, as such, must be authorized by Health Canada before they can be sold.
"It is illegal to sell NHPs [natural health products] in Canada unless they have been reviewed by Health Canada and authorized for sale," Christelle Legault, a spokesperson for Health Canada, told The Canadian Press in an email.
"To date, Health Canada has not licensed for sale any drug or NHP that contains salvia as an ingredient."

No need to get dispondent. You can still buy it in head shops.
The law simply says the Head Shop can't sell it. If they sell it, and you buy it, they are the ones who have broken the law, not you.
And from what I can see, many head shops are still selling it. So buy it, and smoke away. Just don't sell it on to anyone yourself. :)
Head shops? As in she stores that sell all the bongs and pipes and whatnot?
