If my parents receive my supplemental security income can I take it since its mine?

I'm 18 but my parents keeps it for them selfs and spend it but it's my check i receive each month

It would seem being that you are an adult, but they are still your representative payee, that you have some sort of disability that warrants supervision of your money. It might be required for someone to handle your money for your so that your bills get paid. I don't know your situation, but usually they do that with people that have judgement issue who would blow their check on things they don't need rather than paying rent, utilities, for food, basic clothing, health care expenses, etc. Sometimes it happens with people that are alcoholics or addicts. Other times it's for mental deficiencies.

If you are now 18 it is theft. If you are told by your state to take a cut and pay them rent and utilities to live with them then you have to do that. Otherwise are they your full time caretakers? They might have been made to care for your income if they had you signing forms to do that waving your rights. Call your local benefits office and ask.

If they get it because you're their dependent, it's theirs. If you live on your own and it comes in your name, it's yours.
