The reason the marriage failed is rarely a factor. If she spent years not working to raise children and maintain the home, then she's reasonably entitled to some support. In Texas alimony is rarely awarded, but the joint assets aren't always divided 50/50.
I don't believe in alimony for any reason. I'm childfree. You get an upgrade living with me. If you cheat you lose me, you lose that upgrade. I don't keep paying for a VCR that broke 30 years ago.

Think it depends on the judge but usually it's more of your better off with a job then her...
a lot of women chest and have back up men when they divorce while the man is left with nothing but a job.
Yet cause the mom got the kids he has to pay?
Ofc they were still married for that time. Cheating or not doesn't change that
But cheating is a betrayal of the marriage
@Telekinetic-Potato that doesn't mean she didn't sacrifice during the marriage. a lot of women stop working to care for their kids and husband's. It's not fair for him to gain success and she had to sacrifice
We lack the concept of alimony/spousal support here in Japan, and probably because even the most traditional wife worked alongside the husband and secured her own livelihood.
I think it's a better system since, for example, it prevents anyone from marrying for nefarious reasons with the hopes of divorcing and receiving the other's assets. It also eliminates any need for prenuptial agreements.
Alimony should just be abolished in general in my opinion, yet it especially shouldn't apply to cases involving infidelity as that's already a violation of the marriage oath.
Alimony is because of divorce, right? I'm asking because every European country has different rules, lol. And I don't really know what it looks like in the US.
But if it is related to the divorce, not the reason for the divorce, then I would say - yes.
@JHAYES317 that's why I asked what alimony is assigned to by law. To the divorce or to the reason for the divorce. But it looks like it's assigned to the divorce itself. So, by law, she can get alimony
@JHAYES317 agree
In most areas of human endeavor there are penalties for breaking social compacts.
If I disclose some of your secrets, you will punish me by excluding me from your friend group. Some of these prohibitions are formal and what we call criminal and some are informal as in withdrawal of friendship.
Cheating is a fairly nasty betrayal and is recognized as such universally. There will be disapproval expressed. But a cheating guy won't be kicked out of the poker games and a cheating girl won't be kicked out of a friend group.
In short cheating is nasty but there are no punishment at any level.
I am in favor of punishment for a cheating guy or girl by a less favorable divorce.
No I think if you cheat you don't deserve anything. I personally think if I ever wanted to leave my husband. I would be like those guys who say they are popping out to get smokes and they are never heard from again. LMAO I would just have a brand new family in a year or so on the other side of town.
@JHAYES317 I am only messing around lol. You are too uptight.
@JHAYES317 Well I wouldn't actually beat my boyfriend up for cheating, first off lol. No guy is worth the time or effort. Most the stuff I say on here isn't actually serious, so I don't know why you always have to go against everything I post. lol
There should be no alimony for anyone, regardless if they cheated or not. Alimony is just another way for women and the courts to steal from men.
They are able bodied adults and can work to support themselves.
I have a friend who glad pays alimony because if it wasn't for her taking care of the kids he couldn't of built his business to 8 figures. So Alimony does exist for reason.
This is a function of the laws in the jurisdiction where the divorce occurs. In "no-fault" states, infidelity is irrelevant. The calculations are based on joint income (if she has one) and then on the length of the marriage.
Separately, child support is based on the income of the non-custodial spouse and the number of children, and extends to either the child reaching the age of majority or a pre-negotiated time (such as college graduation).
Your feelings do not matter.
If they did matter should women get alimony if they are the ones who cheated?
Tell me, in your hypothetical, why she cheated. Also provide hypothetical incomes for both spouses. It is not about gender, it is about income. It is not unusual for the ex-wife (especially in the current social environment where females are more educated and often better employed) to be the payor instead of the payee. Are there children involved? If so, who is the custodial parent? How will being the custodial parent affect future earnings?
Seeing divorce as a zero-sum game is why divorce attorneys are among the highest compensated in the legal profession. Building drama in the process is what keeps them employed. Marriage may be about romance, divorce is simply business.
LOL thanks for the comments
Hell no. I've seen happen too much that a woman has cheated on her man, and the man has to pay her childsupport/alimony because she is too lazy to have a job herself or straight up refuse it. She decides to cheat, let her new boyfriend pay her stuff.
do husbands have to give it when they cheat?
If a husband cheats and causes a divorce in some states that is YES they do.
oh okay... so it is the divorce, rather than the cheating
Correct. There must be a divorce in order to get alimony.
Depends on prenup, and circumstances as it's never clear cut.
But if he's married a gold digger, or neighbourhood hoe, then she deserves the money for being able to fool the idiot into marrying her.
This is even law in my country the side who cheated loses any right to alimony. On the other hand paying alimony is ultra rare in divorces here either.
People stop cheating if you have kids. Wait til they get I don't know if you’re gonna bust some shitty as selfish shit like that. I hate cheaters especially when there’s little kids in the mix. Disgusting Gross type of people.
Nope. The cheater, husband or wife, should not get spousal support nor should the perp get an equal share of the marital estate. Additionally the victim should get primary physical custody of any children.
Only if there are kids in the picture. Traditionally speaking the man works the wife stays home and takes care of the kids. If there are no kids at home there is no reason she can't be working and earning a paycheck.
Understand this does not mean I condone her infidelity in ANY way. I'm simply saying that regardless of her defense, she gave up potential income earning years of her life (even if she never planned on actually working). And she should be compensated for that.
I like the 7 women who voted “yes” to this crap. Seriously what’s the justification?
Alimony shouldn't exist. Child and child support should be taken away if it's found out that the money is being used on other things.
If the husband was good enough, then no.
If the husband was a shitty husband, then it's debatable.
No but I think ALL alimony should be abolished.
If 2 adults go their separate ways neither should ever have to fund the others existance.
I do not work and toil at my job to fund the existence of someone I USED to live with.
It should be one factor for the judge to consider. They should not be barred from considering it, but they should make up their own mind on a case by case basis.
No woman should get alimony for any reason. Alimony is just grossly unfair and very sexist.
Maybe from the one she cheated with…. Might cut down on the cheating…
Mainly it would depend on why she cheated. I’m not saying it is ok to cheat, but a few time it could be justified.
Yes, because if they divorce, why it happened is irrelevant, in my opinion.
i thought it said if she is cheated ON. i pressed the wrong button.
It should be abolished full stop. Cheating even more so.
Life doesn't work like that.
that is the problem
Hell no, this is why I’m never getting married and never having kids. Women have too many rights. Too much power over men.
Its depends on a lot of factors really. But for reall whoever cheats shouldn't be given anything after that hurtful action.
I cracked up when I saw 29% of the girls said yes. 🤣🤣🤣
Whoever cheats should pay alimony not the other way around
What a disgusting reflection on modern women it is that a third of them voted yes.
She should have to pay the husband, even.
No brainer. Heck no 😛
She should get nothing
No. Why should bitches get a reward?
of course no
In some states they are
WHO DO YOU THINK VOTED YES?
Say WHAAAAT?
