So a happy couple is expecting their first child together, the woman dies during the birth and the grief stricken newly father now, not only has to adjust to raising the child on his own, he has to either pay a big fine or face possible jailtime for the crime of having consensual sex with his girlfriend/wife 9 months prior?

Hell no, she literally decided to keep the kid. That at least a 3 month window. Not to mention the doctors would have notified her if she were in danger at any point. Would still end up her final decision. Is it sad? Definitely. But charged with essentially involuntary manslaughter? No. Lol just no.
