A trademark is used for a good, while a service mark is used for a service. Therefore Democrats are arguing that Black people are a good to be sold and traded on the open market. That really goes back to their slave trades days. Trademarks don't apply to language used in regular conversation. They wouldn't be able to stop people from using the word Black person unless the person was selling Black people as slaves. The second party without the trademark would have to come up with a new product name like Darkies.
