Former U. S. Secretary of Education Betsy DeVos, appointed by former president Donald Trump, told conservative activists in Tampa Saturday that the federal Education Department should be abolished, leaving education decisions to state and local boards.

“I personally think the Department of Education should not exist,” said DeVos, author of a recent book called “Hostages No More” and a keynote speaker at the “Moms For Liberty” summit. Members of the audience leapt to their feet, cheering and applauding.

DeVos is one of the prominent Republicans featured at the three-day summit in Tampa, which provided training to members from 30 states on how to create conservative majorities on their local school boards, in what they call a parental-rights movement. Moms For Liberty was founded in Florida, sparked in part by parents’ objections to their children being required to wear face masks at school during the height of the COVID-19 pandemic.

First, a little background on the Department of Education...

The Department of Education is not a very old department.

When I was a kid, there was a department called "HEW" - Health, Education, and Welfare." But, in 1979 during the Carter Administration, HEW was broken up into two departments: The Department of Education ("ED") and the Department of Health and Human Services.

The GOP was always against the creation of ED because they felt it was unconstitutional. The Federal Government didn't have an enumerated power under Article I Section 8 regarding education; that was always considered a domain of the states.

Many disagree though and say that the Federal Government does have a power regarding education under the Commerce Clause of the Constitution which is in Article I Section 8:

"The Congress shall have power... regulate commerce with foreign nations, and among the several states, and with the Indian tribes;"

Since education is critical to understanding and being competent at commerce throughout the USA and the world, they feel that the Federal Government does have at least some power regarding education.

So why is this so upsetting to Republicans? We need to go back in history...

In the early history of the United States, America wasn't very united. We united to fight the British, but each colony-the-state retained its own identity and culture to a point. States were often bigoted toward one another not unlike Europeans are to each other or in other parts of the world.

This is why the first government of the USA was under The Articles of Confederation. It quickly became apparent that The Articles of Confederation wasn't going to work out - no confederation ever does - so, eventually, it was scraped with the current form of government under the US Constitution replacing it. The US Constitution compels a stronger sense of unity.

But, still, there are continued bigotries among states to some degree.

Now, one of those bigotries goes along the line of something like this: "How would somebody from [some other state or the Federal Government] know what we need to teach our kids here in [our state]?"

Each state is distinct and with a distinct history and culture to a certain degree.

And, that's the key here: the different cultures. The real problem is religion and "the culture wars". Red states dominated by Christian conservatives don't want their kids thinking that sinful acts like homosexuality are OK. They see the Federal Government having sway in what is being taught as a threat to their beliefs. Generally, they don't want the Federal Government to put pressure on states to teach things like diversity and separation of church and state, and evolution all of which are offensive to their sensibilities. Even worse, but unspoken, is that the races shouldn't mix. The 1954 Supreme Court case Brown v. Board of Education and the subsequent showdown in Little Rock Arkansas in 1957 cemented the view that the Federal Government is forcing people to change their ways against their will.

Succinctly, education is information and information is lethal to bigotry. If you like your bigotries - and the GOP needs them to survive - you have to be against education that nullifies your bigotries. They don't want the Federal Government, via the Department of Education, to force them to change their ways.

If your going to use the "commerce clause" to claim power over everything you really don't have much of a need for any of the other enumerated powers for everything directly or indirectly effects commerce.

There is of course the problem with the compartment definition of the word "regulate" which was simply to make regular as in abolish barriers to the same. Such as New York before had attempted in giving legal monopoly over its waterways as to block or tax business of other states, or Washington & Oregon are today attempting to prohibit oil and Gas export from Idaho and Montana.
Not mandate, or control in any control in anyway. The word 'among' the States also precluded intrastate commence, which of course takes you even further from the idea of controlling anything inside the state.
The hand picked Federal employees in black robes didn't rewrite this until the 1940's after the 'switch to save the 9' where they decided everything was effectively interstate commence to allow FDR to do what he wanted.

Its also worth noting that there was no such great agreement that the Articles of Confederation had failed, indeed the original Constitutional convention of 1787 was only authorized to propose amendments to said articles to give the new government Taxing power. When the Federalist who attended decided to write an entirely new constitution instead it was very controversial and nearly failed. Clearly they didn't feel the Articles were a compete failure, and the federalist just abused their limited grant of power.

It taught me how outbreeding depression can occur and how race mixing can produce offspring unfit for the environment you evolved in. Honestly, I kind of agree the education in this country sucks... and its hard to say the education department did anything in the last few decades that has helped. I think kids are more stupid then ever these days and therefore easily manipulated.

Republicans want to strip all power from the federal government, and leave *everything* up to the individual states. It makes sense. GOP policies are becoming less and less popular, and that's only going to continue (and perhaps accelerate). They already have very little chance of winning the popular vote, and even with the electoral college system heavily biased in their favor, they're increasingly going to struggle to win national elections (their decision to go with Trump shows just how desperate they have become).

However, while they may have already lost the country, they can still win some individual states - and as we've seen in Texas, now that they've stacked the supreme court as well, that allows them to pass laws that most of the country would be strongly opposed to. Essentially, they've realised they can't get anything done at a federal level any more, so they're focusing on getting things done at a state level instead.

Now, she DID start to eliminate the horrific changes that then-vice president Biden implemented, since he (and a disgusting number of other Democrats) is revolted by the idea of "due process"; of not punishing people who are accused of crimes without some kind of "trial" or inquiry into whether they actually did it- I suppose that DeVos's inability to undo those changes completely could have driven her to decide the whole thing should be chucked and left to more local groups.

It's worth mentioning that schools are controlled by local school boards and funded by local property taxes and state taxes, so what role is the federal government supposed to be playing with schools and education? Sure, ensuring that segregation doesn't happen and standardized student loan info (FAFSA) makes sense, but do you need an entire cabinet-level department of 4000 employees and a $70 billion budget to do that? In the grand scheme of things, the dept is young, established in 1979. It might make sense for the dept to standardize curriculum across all the states, but that doesn't happen... every state (and in some cases, parts of the state) have their own curriculum and standards.

The Federal Department of education along with all related Federal Education laws are not legitimately allowed under the Federal Constitution.

The Job of the Federal Government is to protect the States from forign threats not itself become the oppressor tell the people how to govern themselfs domestically.

As far as "critical race theory", something like this is what should be taught:

In the United States, we had slavery from the dawn of colonization until the end of the Civil War. But that was not the end of the Civil War: In the 150 years since the Civil War, there have been efforts by certain Whites to prevent Blacks (and other minorities) from having lives of equal ease and opportunity as Whites who are the majority in the United States. Examples are the Jim Crow laws. Subsequent legislation has sought to combat this including the 1954 Supreme Court case Brown v. Board of Education of Topeka Kansas, the Civil Rights Act of 1964, the Voting Rights of 1965, the 13th, 14th, 15th, and 24th Amendments.

The 24th Amendment is a good example of this oppression and subsequent correction. The 24th Amendment, ratified in 1964, removed poll taxes from the ability to vote. A poll tax is a fixed-amount tax applied to everyone. In the former Confederate states, they instituted poll taxes that had to be paid before a person could vote. The idea is that, since Whites were generally more affluent than Blacks, it would be easier for Whites to pay a poll tax and vote than it would be for Blacks. So, if you make the poll tax sufficiently high, this will de facto disenfranchise many Black voters before disenfranchising White voters. In other ways, it was a method to prevent Blacks from voting despite their legally being allowed to do so since the 15th Amendment, ratified in 1870, giving men the right to vote regardless of race and the 19th Amendment, ratified in 1919, giving women the right to vote. This is why there were so many Jim Crow laws and how Blacks tried to respond with "The Talk" and "The Green Book". "The Talk" is a discussion within Black families with parents teaching children on how to behave when confronted by authorities, who are usually White, so as not to have the situation escalate and you come to harm. "The Green Book" was a travel guide within the Black community that provided a list of lodging and restaurants that were friendly to Blacks. This was necessary because many hotels and motels, gas stations, and restaurants did not permits Blacks to stay, fuel up, or eat. Thus, Blacks needed a guide so they could adequately plan to travel long distances. Note that Whites did not have to do this. This is an example of White privilege.

Now the question that should be asked is: Are Whites natural oppressors and Blacks or other minorities natural victims?

Not really. This is a sad fact of human nature that all minorities face in a society with a majority ethnicity. The examples that I have given are with Whites and Blacks, but other oppressions like this have existed too. For instance, many of the early colonists were religious minorities who came from England because they were oppressed by the religious majority. In this case, the majority and minority are both White, but the minority is a different religion than the majority. To escape that oppression, they came to America where they could live without the oppression from the majority back in England.

So, this is why you need to understand that "Critical Race Theory" is something of a misnomer, because the root problem is based in human nature. The historical oppression of Blacks by Whites in the United States is just one example of this. What's important is that all of us overcome that aspect of human nature and simply live with this Golden Rule: Treat others as you want to be treated by them.

Now, the reproduction of all animals, including humans, involves the combination of DNA and then gestation - that period between conception - the creation of a zygote - and "birth" - being a solitary living animal in the real world.

Normally, this is the situation:
Males are born with male genitalia and vice versa for females.

Males are attracted to females and vice versa for females.
This is called heterosexual attraction and such persons are called heterosexuals.

Males are born perceiving themselves as male and vice versa for females.
Such persons are called cisgendered.

It is important that these are three separate aspects of who a person is. What is also important is that all three of these are governed by different parts of a person's DNA and development.

For homework, learn about sexual chimeras and write an essay about how this could lead to homosexuality or transgenderism.

2. As for transgenderism, yes, it's a fact of life. Mutations and complications arise which create organisms that are "different" from what is nominal. Transgendered persons, homosexuals, hermaphidites, Turner females, Kleinfelter males, heterchromats, albinos, conjoined twins... I could go on for hours... are all examples of this. What is important about the subject of transgenders in education is these people exist and are different than most other people.

Now, as for the question about bathrooms or fairness regarding sports - like should M2F transgenders be allowed to play on girls' athletic teams or which bathroom to use, I don't believe that is in the scope of a biology class. I don't think anything should be mandated there - to be clear, these are questions, but I don't think there are objective answers that should be mandatorily taught. I do think that the questions should be taught though because (and this has nothing to do with transgenders), these are examples of "ripples" or complications in society in response a change in society. Another example of that would be something like: "If we have robots replace blue collar jobs, what should happen to blue collar workers? Should we make full-time be less hours, but pay them more so we can accommodate all the workers who would otherwise be displaced? Or should we re-educate them for jobs not done by machines? Or?"
