No, it shouldn't be. Depending on who you allowed to define it in legal terms, it can mean *anything*. From the smallest nitpicks to the point where it is blatant and doesn't get counted.
Even if it is completely reasonable, getting someone arrested because they said something racist doesn't teach then why it is wrong. They cam just use code words especially if the enforcement is algorithmic. This is why censorship doesn't work if you're trying to get people to stop talking about anything.

If it results in violence, it's a crime. You'd have to then prove it was based on racism, and it's usually pretty difficult to prove intent
