Not an American but I find the question interesting.

A distinguishing feature between a criminal case and a civil case is that, in former the State, is prosecuting an individual but, in the later case, it is an individual prosecuting another though we might use the word sue more often. Maybe different in US?

If I drive 10 over the limit, I will just get a fine but not a criminal record. Nonetheless all traffic violations are a criminal offences and the state prosecutes me. If I speed away to avoid the police then I get jail time and a criminal record.

It would seem to me in breaking laws, that whilst a State prosecution might not result in a jail sentence it does not automatically make it a non-criminal civil matter. It would seem to me twisting words to argue that it is not a crime but a civil matter just because a jail term might not result. Maybe different in the US?

In our case, an illegal gets flown off for detention on Nauru within 24 hours of marring an otherwise pristine beach with his footprint.

Technically it is not imprisonment but merely detention though if they won't fill in the bloody paperwork, they can be in detention for years.

Detention is in actuality indefinite imprisonment till they agree to buggar off back to where they came from.

It is possible a person might enter legally on a tourist Visa and forget to leave on the due date.

A UK citizen I knew started a successful cafe and decided to holiday in New Zealand when it was running well. When he came back he was deported on a plane back to Jolly Old England and is now banned for quite a lot of years. He needed to get a re-entry visa back to Australia from New Zealand and simply mucked up doing the paper work. It does happen.

I am curious if the US considers 'the first country of resort' principal. Obviously a refugee has to get into Mexico first and if a refugees are accepted in Mexico the refugee should immediately apply there.

It is not codified in the convention or protocol but a lot of countries won't accept country shopping and expect asylum claims to be made in the first safe country entered. There was always that expectation and if a refugee was in fear of their life they would apply for aylum in the country of first resort then seek resettlement elsewhere if the wished.

Doing otherwise implies that the refugee is an economic refugee and the Convention and protocol don't acknowledge economic refugees.

When a person enters the USA without proper documentation, they've committed a crime which refers to the act of violating a law, whereas being a criminal typically implies a person who has been convicted of a crime. So technically, you're not a criminal "yet". This was Scump's defense throughout ALL the charges brought against him, including the stolen documents. He violated the law, committed a crime, but claimed he was no criminal.

So due to the way our laws work, once you're in the USA without documentation, if you're arrested it's still considered a civil violation UNLESS or UNTIL you're prosecuted in CRIMINAL court. Hence, the concept of "due process".

How and what you are charged with is ENTIRELY up to the body of jurisdiction. Say for example the country that they are fleeing from does not want them to go so they fortify and blockade legal ports of entry to prevent their citizens from gaining access to the other nations legal ports of entry.

There are also other arguments but I think that demonstrates it enough. As such the law was always that you can gain entry in pretty much any creative way you want as long as you dont go overly crazy on the illegal means just for the fun of it and you are not limited to legal ports of entry but literally anywhere inside the country when seeking official asylum.

As such an asylum seeker could legally (through illegal means) cross into Texas and then travel all the way to California (as an example) before seeking asylum if they wanted.

Of course the more you bend this law while seeking asylum the harder you need to justify it through your circumstances. Its harder to claim it was necessary to dig under the wall if you could have just shown up at the door and gotten a friendly hug of welcome but the law is intentionally left very vague to allow for interpretation as the situation requires.

So to recap. Your concern about the food stability in USA is based on false information and the solution you believe in would actually make the situation worse.

USA's asylum system and legal immigration system is so bad that it has international notoriety and there are people that has been in the process of gaining legal citizenship for over 10 years without results. Like 30 minutes tops maybe? and then wait like a week or so to give the labs some time to give back the results as well as for the paper pushers to enter you into the database for you to become a citizen.

Illegal immigration doesn’t put a strain on food distribution as the production of food isn’t the problem in the US and actually illegal immigration often leads to lower food prices because farmers hire illegal immigrants so that they don’t have to pay them as much which leads to cheaper production which ultimately leads to cheaper prices. As for putting them up in hotels I don’t necessarily agree with that however studies have shown that illegal immigrants more times than not benefit the US. If we’re just securing the border and deporting the actual few violent criminals cool but mass deportation is not only immoral put illogical.
