If I were a law enforcement officer and I thought i was being shot at, I’d shoot first and ask questions later too because I would not allow some agitator to kill me

I think I understand your question. The ICE agent was removing Pretti's gun and it accidentally fired which made the other agent pull his gun and fire into Pretti's back. Then fire a lot more into his back.

I think that's what you are going for. If that's the case, then yes, in my opinion it is still murder.

Anyone claiming to be law enforcement or a Federal agent should have received training that would allow them to function well and react well in stressful and quickly developing situations.

If this happens to be a case of accidental firing of Pretti's gun while being handled by an ICE agent causing another ICE agent to open fire into Pretti's back, then this is a clear case that their training is completely inadequate and they should be held accountable.
