Should President Trump stop Zohran Mamdani from trying to arrest Netanyahu in NYC?

Mamdani says he is reviewing whether New York City authorities could arrest Netanyahu if the Israeli prime minister travels to New York in September to attend the United Nations General Assembly, based on the International Criminal Court’s warrant. But the United States is not a party to the ICC’s Rome Statute, and a city mayor cannot independently conduct foreign policy or override federal law, diplomatic protections, and America’s obligations as host of the United Nations. An attempted arrest could trigger an immediate constitutional and diplomatic crisis, damage relations with Israel, disrupt the U. N. General Assembly, provoke litigation and federal intervention, and create dangerous uncertainty for visiting foreign leaders. Whatever one thinks of Netanyahu, a mayor should not attempt to turn New York City into an independent actor in international law. That is why I believe President Trump should intervene if Mamdani seriously tries to carry this out.

An ICC warrant is not a verdict. The ICC itself lists Netanyahu as “accused” and says the allegations rest on “reasonable grounds to believe”—not proof beyond a reasonable doubt after trial. Calling him an “arch criminal” and demanding “Nuremberg-like trials” therefore prejudges guilt and substitutes rhetoric for due process.

Nor does an ICC warrant automatically authorize every government official in every country to make an arrest. The United States is not a party to the Rome Statute and has not accepted a general treaty obligation to enforce ICC warrants. Extradition and international-arrest matters are handled through federal legal and diplomatic processes, not unilaterally by a city mayor.

Netanyahu may be investigated and criticized, but allegations must be proved in a lawful proceeding. Comparing an elected Israeli leader to convicted Nazi officials before any trial is neither careful legal reasoning nor respect for international law—it is an attempt to declare the outcome in advance.

My objection is not to fair trials. It is to selective justice—demanding Netanyahu’s arrest while ignoring alleged crimes committed by Iran and its allies—and to comparing him with convicted Nazis before any trial has determined guilt. Apply one legal standard to everyone, or admit that this is political rather than principled.

And simply calling Hamas “resistance fighters” does not erase allegations against Hamas leaders. The ICC itself issued a warrant for Hamas military commander Mohammed Deif based on alleged crimes including murder, extermination, torture, rape and other sexual violence, cruel treatment, and hostage-taking. If an ICC warrant against Netanyahu deserves to be taken seriously, then the ICC’s allegations against Hamas cannot simply be dismissed because you consider Hamas the resistance.

That is precisely my point about consistent standards. Netanyahu is accused, not convicted. Hamas figures accused of international crimes likewise deserve lawful proceedings rather than predetermined guilt or innocence based on which side someone politically favors.

And I never argued that criticism of Israel is antisemitic. My objection was to comparing Netanyahu and Israeli leaders to convicted Nazis before any trial has established their guilt. Calling one side “Nazis” and the other “resistance fighters” before adjudicating the allegations is exactly the kind of prejudgment I am objecting to.

Apply due process and the law consistently to everyone. That should not depend on whether the accused is Israeli, Palestinian, Iranian, or anyone else.

Accusations can absolutely justify investigation and trial. But an accusation, an arrest warrant, an investigative finding, and a conviction are not interchangeable.

The ICJ genocide case against Israel is still ongoing and has not produced a final judgment finding Israel guilty of genocide. Its provisional orders protected what it described as plausible rights under the Genocide Convention; they were not a final ruling on the merits. The ICC warrants against Netanyahu and Gallant concern specific individuals and were issued on “reasonable grounds,” not after a trial or conviction.

At the same time, serious UN investigations have accused Israeli authorities and forces of grave international crimes, and those findings should not simply be dismissed. They should be examined through evidence, legal proceedings, and individual accountability.

But saying “Israelis know they are committing genocide” assigns guilt and intent to an entire nationality. The Nuremberg defendants were tried as individuals based on evidence; all Germans were not collectively convicted.

I am not excusing any proven crime. I am insisting on the same standard for everyone: investigate the evidence, prosecute those responsible, allow a defense, and distinguish allegations from legal guilt. That standard applies to Israeli officials, Hamas leaders, and anyone else accused of atrocities.
