
What do you think of former President Donald Trump being indicted on federal charges?


I actually think he's in deep shit and that this is worse than even I had earlier imagined.
When he is arraigned on Tuesday, they will likely not take a mug shot (although I would love it if they did). I expect he will be released on his own recognizance, but I believe there is the possibility that they will make him surrender his passport and consider him a flight risk.
However, the judge in this case, Aileen M. Cannon, was appointed by Trump and has already illustrated poor judgment earlier in this issue (*) having been overruled by the Eleventh Circuit Court of Appeals.
Ideally, Cannon should recuse herself in this case. If she shows any partiality or exhibits more suspect decision-making, US Attorney will likely go to the 11th Circuit to either overrule her or get her dismissed outright.
Honestly, though, I am not sure how Trump is going to get out of this unless there's a mistrial from a hung jury which is a definite possibility in Florida. However, if a grand jury could indict, a regular jury could convict.
Personally, Trump is guilty - the evidence is clear. I wish I didn't have to say that, but it's true; too many witnesses, recordings, photographs.

Those allegations include: moving boxes out of a storage room; telling an attorney to search that room for classified material without saying that dozens of boxes were being kept elsewhere; suggesting an attorney hide or destroy documents that had been subpoenaed; and causing another person to make false statements about whether all the classified documents had been produced.
“That’s not the kind of evidence you typically find in a case like this, and it’s certainly not the type of evidence so far that has come out of the Biden investigation or the Clinton email server case,” Mintz said.

The really troublesome part of all this is that despite the rest of the issues we face in the USA, stupidity, ignorance and cultism are the biggest problems. This post wasn't about Biden, inflation, oil, law enforcement or other corruption. It's specifically about Trump's ILLEGAL possession of classified documents that are SO serious, it puts the country in danger.
That fact makes it worse, but the point is that he knowingly STOLE these documents, lied about returning ALL of them, had his attorney lie to the DOJ, and there's evidence he shared some of this information with "friends" who had no clearance to see it, and neither did he any longer.

Let me preface my comments by noting that I am a Republican who is no fan of Mr. Trump and in fact did not even vote for him the first time. (Though I did vote for him in opposition to Mr. Biden.) I am no fan of Mr. Trump's populism and thus I come at this question from the perspective of what might be called a Tory conservative.
To start, as a legal matter, Mr. Trump is innocent until proven guilty and he should be so treated. That said, the preponderance of evidence that the public has seen - including a video tape in which the former President is seeing "showing off" classified documents - seems to point to Mr. Trump's guilt.
This is less surprising that it may seem. Mr. Trump's brand of populism has nothing but disdain for the established institutions of society. Which in his world view are the product of elites. Thus, it is not too surprising that he should conduct himself with a proportionate level of disdain for the laws and institutions of society.
Nevertheless, the question of whether or not what Mr. Trump is accused of doing rises to the level of a felony - rather than mere misdemeanor - must be left to the courts. It being noted that Presidents and even former Presidents are given enormous latitude in how hey use and keep the classified documents that they accumulated in their administrations.
Thus, in many respects, there may be less here than meets the eye as a legal matter. In terms of national security, however, Mr. Trump's disdain for the institutions and "elites" of the nation he presided over may have put the nation at risk. Certainly, however, his populism is an acid that is eating away at the nation's culture.
In this, however, Mr. Trump is hardly a pioneer. The most fundamental issue being that Mr. Trump's opponents have been as cavalier with the laws, institutions and security of the nation as he has been.
The Republicans - and Mr. Trump - have one rock solid argument when they point out that there is a mountain of evidence that several Democrats, not least former First Lady Hillary Clinton, and the sitting President himself going back to his days as a Senator from Delaware, have violated the laws on classified documents. Yet the Democrats have made sure that the Department of Justice, on their watch, conveniently ignored such violations.
The point here is not just the double standard. Rather it is the construction of social consensus that disdains the institutions and laws of society. The law is seen not as a force for stability and fairness, but rather as a cudgel to be wielded against one's opponents.
This ethos is permeating not just the nations politics and institutions. It is sunk roots deep in the culture as the law is seen as little more than a tool of power or a mere inconvenience. Thus is the nation experiencing soaring crime rates, wokeism and all the rest.
It is to be hoped that justice, based on the evidence, will be done in the case of Mr. Trump. Then also in the cases of the Mrs. Clinton and the Bidens. There needs to be some scintilla of proof that the laws and institutions of society serve the people, and not merely that they are to be used according to convenience.
Neither Mr. Trump nor Mr. Biden are the equal of the office that they held or hold. As noted they are small men of limited character and no historical perspective. Both are men of limited character andshort term thinking and yet the public deemed them worthy of public office.
In this, they are both symptom and not the cause of the nation's current distresses. That is the main lesson that should be drawn from Mr. Trump's indictment. It says more about the character of the nation than it does of the man.
Aside from the fact that he had a right to said documents as a president. The real problem is political, its going to be a lot harder convincing every president going forward to peacefully give up power after an ugly election.
The Raid itself was crossing a Rubicon we can't uncross, not only because it gave his opposition the chance to spy on him and his campaign. It meant charges would be made no matter what based upon the history of the FBI. Everyone knew no matter what they would find or make dirt to charge him with given every single American violates 3 'federal' laws a day.
This indictment just seals the ultimately dooming American democracy, its only a matter of time now before a truly corrupt administration decides they would rather not take this risk in handing over power to their enemies.
There was a good reason the Federal goverment was never given this power in the Federal Constitution, not even impeachment allows anything beyond removal from office for this simple reason. Its not worth it!
Nothing you will ever gain from persecuting a former president will ever amount to anything even close to being worth it.
Existing presidents will simply see that as a compelling reason not to become former presidents, and given the enormous amount of power congress has invested in them as well as the hate of each faction they have both the support and the means to make that happen.

He can do this in anyway he sees fit because the chief executive is the person for whom theses secretes exist to enforce his policy. That is the nature of an chief executive office.
As such all classification and protection rules exist simply as a means to express the President's will, that is why they are defined in executive orders.
Once the president has decided a document is no longer classified and choose to give it away making it public information you cannot reclassify that document nor criminalize its possession anymore than you can criminalize the possession of any other public information.
For that reason it is ridiculous to accuse a former president of such because its impossible to say whatever he had from that time he was president what he personally thought was classified vs what he thought should be given away.
Anyone else you have a case because they require paperwork in accordance to the president's express will. But the president himself doesn't require anything at all. Anymore than you require a permission slip to drive your own car.

Its fairly obvious their choice to charge Trump has nothing to do with any particular behavior, as obviously Trump generously allow the goverment to take whatever they wanted. And was in active talks to give them even more.
Never-mind the fact that the goverment was not actually entitled to any of it.
These speculative excuses ultimately won't make any difference to the long term political consequences of this act. Consequences which will become self-evident when a future president decides they would rather not step down and risk such abuse.

As a refresher, consider brushing up on the unanimous opinion in the July 1974 US Supreme Court case "United States v. Nixon". The Court said "Marshall's statement cannot be read to mean in any sense that a President is above the law."

Under the Presidential Records Act, upon leaving office, the President must surrender documents that are the property of the United States, no matter what their nature.

It's just that simple: Once you leave office, give back to the United States what it owns. That's what the Presidential Records Act is all about and why it was created in the aftermath of Watergate. If he had just complied with the request, there'd have been no issue.

Obviously there's proof because these are series charges. What would he want with classified documents if he wasn't planning on doing something with them. I think he sold them to Russia or some other country, or maybe multiple countries.

@Red_Arrow Biden has documents from when he was senator and vice-president (which he was not authorized to have) and they are stored in various unsecured locations and nothing is being done about them. Trump had them in one location protected by his secret service force due to being a past president. How do you think that other past presidents got the documents for their presidential libraries? Now Trump does not have any documents for his library and congress has not yet authorized any for funds for it as they did for other past presidents.

What about prior vice-presidents, senators, and representatives who have retained documents and never been charged? None have retained them in secured places and some have even retained the documents in multiple unsecured locations. Why should Trump be denied documents for a potential Presidential Library and why has he not been allocated funds for a presidential library like all recent prior presidents? We are on the verge of loosing our country and our freedoms and having a one party communist police state like China and Russia with everything that has happened over the past two years if it continues.

If Trump wants documents for a presidential library, he first has to have the library with appropriate security before he can have those documents. And he probably has not been allocated fund for a presidential library for two reasons. First, he never asked. And second he has been shown to disregard security concerns and it is now known that he will show them to anyone and everyone.

And it is also illegal to "declassify" by simply thinking about it. And it is also illegal to not give documents back after it is requested on multiple occasions. @WhiteBoyChill you are confused as usual. A two tiered justice system is when Donald "Fats" Trump never spends a day in jail but you or I would (for decades) for committing a fraction of his crimes.
@Mac-One Prior presidents had them boxed and shipped to federal archives as required by law. And Trump's country club bathroom, ballroom, closet, etc. are not locked secure places, nor is out in the open on tables with guests looking them over, and none of the other presidents displayed them like that. And to declassify documents, a form has to be filled out for each document that is declassified and the classification markings have to be deleted or overwritten. None of that was done for any of the documents that Trump was showing off to everybody who came through.

Even just the fact that the feds knew all along Trump had the documents in advance suggests it was all just a political hit job.

Kid, are you a bit dense or something? To declassify secret documents they have to go through a strict legal process. They don’t get declassified by „thinking about it“, as the Trumpster suggested. The judge will make that perfectly clear in the courtroom.
@WhiteBoyChill Although presidents have power to declassify just about everything, they have a legal process they have to do which is to fill out forms to declassify each and every item declassified, and then the things that are declassified have to be marked as being declassified and all markings saying they are classified have to be removed or covered. Trump did not do that with any of the documents so all of them are still classified.

A Trump-appointed judge handling the documents case in the southern district... I have family that works in that district court... It's almost like it's a movie... All for show... You know to set legal precedent. It's funny how the commies never learn.
I suspect that's mostly just a distraction from some scandal that hasn't blown up into a scandal yet, but Donald Trump engaging in criminal activity would hardly shock me. By all means, if he DID break the law, then try him and, if he's convicted, throw him in prison- but don't stop with him.
He is not the first. There have been presidents of the United States who have been indicted multiple times. Some have even been assassinated. Yet their legacy lives on.
Trump may not have been perfect but American got a chance to have a leader who made them laugh and smile. Many people underate the blessings that those two things bring to life and economies.

Trump could seriously screw up the system so I'm not surprised. I'll be surprised if any genuinely random jury convicts him of anything though.

Trump admitted on TV that he kept the documents at Mar-A-Lago, which he claims he was entitled to do. The law says he wasn't, so far from "nothing to go on" the Justice Department has a slam dunk.

It doesn't matter if the documents were declassified or not (they weren't), they're not his documents. Biden gave back the documents he had (which he probably forgot he ever had them).

All classified documents should lose their classified status within 5 years of their creation, unless they contain current spies or espionage methods. And those documents should be declassified when they are retired.
This is a distraction. Th real story is the document James Comer just got from the FBI which details a 5 million dollar payoff that Biden got from Ukraine when he was VP. You will not hear a peep about this on the fake news.

I watched that Nora O'Donnell and not one word was mentioned about this document or the fact that Christopher Wray had to be threatened with contempt of Congress before he would turn it over NOT ONE WORD. Meanwhile all they talked about was Trump's non crime of possession of unclassified documents.

When he took the docs he was POTUS. As POTUS he has full authority to declassify. On a recorded call he said he had classified documents, an apparent admission that he failed to do so. Had he simply done so and made it clear, there would have been no possibility of a crime here. Even if acquitted or tossed out, this should demonstrate his inability to properly exercise the powers of the office.
