If we date while she’s preparing for divorce, is it cheating?

It depends. If they’ve both agreed that the relationship is over, finished then I don’t think there’s an issue w it. But if one person isn’t wanting a divorce but the other is, to the one person who doesn’t want a divorce that could be considered cheating. It also depends on what state they live in. There’s different laws per state as far as what would be defined as adultery. Then there’s also from a religious point of view what is constituted as cheating. If I was you’d I’d stay out of it until things are finalized. You don’t want to be labeled as the reason for why they directed. Possible ex husband coming after you, threatening you or something. Now if you’re just looking to plug her a few times, that’s up to you.

I just met a really hot 38 year old woman with no kids in the middle of divorce about a week ago. I don't give a crap about the "cheating" aspect of it. Her marriage is over in her mind as she tells the story. And we really hit it off.

The only thing that gives me pause is a woman in that situation may be really vulnerable and not thinking straight. I may be momentary validation or an escape from her current problems in a time where she needs something to make her feel good about herself. Like a man still finds her attractive. Her life isn't a failure. The sun's gonna come up tomorrow. A man's arms around her making her feel safe. I'm not looking to take advantage of her and I'm not really looking to get burned myself.

This one to proceed carefully on since I'm likely in a better position than her to control my emotions and see the bumps in the road coming.

Until she is legally divorced then it’s cheating in legal sense. If the actual relationship between them is mutually over then maybe it’s not as immoral, but it’s still cheating and you should know that her still husband could use that against her in court if he gets evidence of it.

Cheating isn't about your marriage papers but consent from your partner. If you broke up your good to look for someone else, even if you're not divorced yet.

No, it is not cheating. The paperwork can drag on for months, and life is too short.
