It wouldn't stand up in court. If you look at a lot of fairground rides there's often a sign up saying "you ride at your own risk" this covers them If you throw up it doesn't cover them if the ferris wheel collapses because they forgot to check the bolts.
If these clause worked we'd see them on planes, trains, etc. Why bother with health and safety at all, just include a clause in a contract.
It's also bad publicity, try telling the public a mother can't sue because the lion king ate her kids and pointing to a paragraph hidden her contract.
Seems this is what they are arguing. Like most laws it comes down to the interpretation of the judge. If a judge upholds it then a precedent is set.
Disney don't seem to care about bad publicity.
But yeah it's ludicrous, imagine you have Amazon Prime and because you clicked agree on the terms and conditions the Amazon driver delivering your package can legally run over you in your drive and walk into your home and rape your wife.
last I read on it... is that Airbnb, Walmart, DirectTV and others are going to use the same practice/argument
