So I order something that was an item on pre-order, the incorrect deliver date was way back in July and the Seller of course told me he'd be sending it when it comes out in Oct around the 3rd.
Now the seller is saying item has been delayed from their supplier I believe them since showed evidence of this, but said if wanted ask for a refund so did cause no date estimation. But then it's been more than 30 days so buyback protection no longer exists, and it's been over 90 days they can't refund themselves on their side.
Dispute via bank is what I'm thinking next however it says on their to give the seller 14 days to resolve the issue. Does that mean I have to tell them they've got 14 days to send it or I will do that? Or can I just wait 14 days without saying so?
Also a little issue here is the dispute via bank would be the original amount I paid which technically would be unfair because I've already received a refund on shipping cost since it wasn't sent. Meaning via dispute I would be taking an extra couple of quid which if so what does that mean?
I won't be shocked if nobody knows like myself how to deal with this. In hindsight I should've never got into buying something like this.

I've worked with eBay as a buyer and seller, eBay have their own policies and if you paid for something and didn't receive what you paid for you have every right to contact eBay, the bank won't really do much, contact eBay and they will open an investigation, that includes going through your conversation with the seller and of course the information from the purchase and the dates, you will more than likely have to explain yourself and the misunderstanding and if everything checks out they will pull the money out of the sellers account and refund you your money, that includes leaving the seller in dept of they already moved or wasted the money, I've noticed eBay leans more towards their customers than their sellers, I know someone that had a situation with a laptop case that was described exactly how it was and the buyer said their laptop didn't fit and even that they were at fault they still pulled out the money from the sellers account and refunded it.
I've rang them and they said after 30 day buyer protection they can't do anything.
Bank should because 3 years ago I had a problem with item not been sent after months and got my money back.
The best option id say now then would be to report that transaction as fraud with your bank, they will more than likely create their own investigation and I think best bet you have now would be reporting fraud because technically it is fraud, banks don't play with them fraud reports, I will say I don't know what they will do or how it will play out but that 30 day gap makes it tricky
Lucky the seller has talked to Ebay showing proof of the messages, and they suggested to refund me by paypal just using sending to friends and family so I don't get hurt on it.
So everything should be solved in the morning when that's done and they'll show that proof to Ebay. Meaning luckily I don't have to do such a drastic option.

they can easily terminate their account because they have a little tolerance for fraud, my guess is they investigated him anyways and he gave it up quick lol
Very lucky situation, the 30 days made it tricky, glad the dude wasn't up to anything bad and actually decided to do the right thing
Actually you could be right good thing I did call them, because they did say about checking their account tho didn't get back to me but that maybe led to them pushing him.
So I will never know if the seller was trying to do something bad and ebay got on him, or if he did contact Ebay himself to get that advice and importantly he offered for a refund I didn't push that at first. And he does have a positive account so longs if the refund happens I won't be leaving any bad review.

Yea if he had good rating then he was more than likely an honest person, mostly if they are in the thousands of reviews, usually that means they are high in the eBay algorithm which gives them good income, losing that account isn't worth a simple scam lol
