Can my LANDLORD charge my boyfriend rent? I read the contract and no where it says about people staying in my room?

Okay... I have a roommate, My boyfriend stayed a few nights over and she said "I feel so comfortable around your boyfriend" and said he can stay 1 or 2 nights per week... Now my boyfriend stays only in my room, doesn't use the kitchen or sitting room, just sleeps over in my room for about 4 nights per week.

Anyways... She confronted my boyfriend saying he should pay rent, She claims he's always there - he's there 4 nights until morning time comes up to me around 9-10pm and goes in the morning, We read the contract and NO WHERE does it say about people staying over, or boyfriends stay-over or how long etc...

she's threaten to go to the landlord... My boyfriend doesn't eat any food there, doesn't use anything, literally stays in my room for a few hours... What should I do? My boyfriend pays rent on this own apartment... she's on about the atmosphere but she's the one that started this, My boyfriend at the start bought her food, drink and was really nice and once she said about being so comfortable around him he decided to only stay in the room.

PS:She has people sleeping on the couch in the sitting.
She has the bigger room and en-suite.

It's different everywhere. You need to check the law locally.

My *guess* is that the lease is specifically between you and the landlord - implying nobody else since they are not named on the lease. Even if it's not spelled out in the lease, I think the landlord has a right to regulate who is staying there. Otherwise you could literally have a hundred people in there.

You need to check locally to find out the fine details. Either check with a lawyer, or with the regulatory government agency. In the meantime, I would avoid a confrontation with the landlord. I think it's pretty obvious that your boyfriend essentially living there was not the intention of the lease agreement.

I mean she probably just said that to be nice. It'd annoy the hell out of me if I was sharing an apartment with my mates and one of them brought his girlfriend over to stay the night all the time (assuming they do boyfriend-girlfriend stuff). If she was just sitting there being quiet then I wouldn't be able to tell she's there but the chances are that's not what's going on.

If it's not in the agreement then he probably has no basis to make him pay, but I hope you see your point of view is not right, basically you're abusing a loophole in the agreement. The landlord rented the place to YOU, not you and your boyfriend. You could bring 20 people to sleep there that way. My friend rents an appartment and whenever someone sleeps over she lets her landlord know. Did the add you answered to when you were looking for the appartment mention how many people he is renting the place to?

Your roomate is 100% right. Also notice how she agreed he stays 1-2 nights a week, not 4.

She has no standing to sue you. Only the landlord can do that. To win, the landlord would have to prove to the court that your boyfriend was living there. If the lease is silent about that, she will have a hard time winning.

I think overnight guests are probably permitted, but I wouldn’t be so concerned about the landlord, this is more of a roommate issue.

So, she said she didn’t mind if he stayed 1-2 nights a week. I guess that went fine and all, but now it’s escalated to 4 nights a week, which is now “more nights than not” in a given week — over half the time. Your boyfriend may still be a polite houseguest, but your roommate may just feel like she’s given you an inch and you’ve taken a yard.

I would talk to her calmly and politely, and re-confirm how many nights a week she is comfortable having your boyfriend stay over. You can take this opportunity to talk about her houseguests and their frequency as well. But it may be a little different when it’s a boyfriend staying over as opposed to a friend who comes to hang out and passes out on the couch. I don’t know why, but it’s just a different dynamic and a different vibe in the air when you’re that third party.

So you’ll probably ultimately need to reduce the amount of time he spends there. I don’t know how long your lease is, but it may be time to consider a new roommate, or to move in with your boyfriend if that makes sense at this time.

If he isn't on the lease then you should be fine. You are freaking out for no reason. She can't do anything. Her bark is bigger than her bite. But, if you want to scare her you can threaten her about the people sleeping on the couch. Give her a taste of her own medicine. But literally she cannot do anything she's just a lady who doesn't have a life and wants to give you a hard time.

If she has people staying over what's good for one is good for the other
besides she can go to the Landlord but tell her that she will sink right
with you or she will sink herself. I think she's jealous over your boyfriend
so that is why she's saying what she is saying about telling the Landlord
but where i live in America we have extra people staying not legal by law
and the Landlord never said anything to us. He didn't ask them to pay rent
but the ones staying here are not by my choice.

The landlord can charge your boyfriend because he’s renting the room to you, if there’s 2 people sleeping there he can decide to charge more, it’s up to him. It’s not something that happens once in a while, your boyfriend stays 4 night a week which is more than half a week... why don’t you move somewhere with him? Or why don’t you go and sleep over at his place so he won’t be spending 4 nights at your place?

It depends on what your agreement says about people staying. Specially if it says for one person. Staying over can break the agreement. Like staying in a hotel only paying for one when there are two. You may think it's wrong but if that is the case sorry but you will be in the wrong...

Depends on state law and local laws. For instance, in several states, If the guest spends more than half a month at a place they could also be considered a tenant at that point as well. Some leases have clauses forbidding more than 14 nights in a month for anyone not named on the lease for that reason.

it's kind of wonky but if your boyfriend basically all the time, he has a basis for making a sublease case and demand rent or demand you make a sublease contract with him.

legally he's only allowed 15 days over night in a 6 month time span before you can get evicted for having people there who aren't on the lease. it's some stupid federal law. also if her name is on the lease and he's there more then 15 days over night you both will get evicted because of that. also for future reference a landlord needs to give you 48 hour notice before entering your apartment another federal law
