If your spouse is missing, are you single, married but separated, divorced?

Scenario:
If your spouse goes missing for more than 3 years (only their items and cell was found but not them), you don't know if they're even alive what is your status?

Would you consider yourself single, married but separated, divorce or something else?

They could've died in an accident, been kidnapped for years, been murdered, etc. You don't know what happened to them. They've been missing and you got no answers.

After a certain amount of time you can have them legally declared dead, but unless you do that you are still considered married. If you have it done then you are widowed and single.
