I am not a cop. I am licensed to carry a firearm everywhere allowed by law. I do so everyday. Since I will be required to take responsibility for my actions, these type of scenarios frequently cross my mind.
What the Homeowner did was STUPID, UNWISE, and very ILLEGAL. He has also embarrassed the "gun carrying" community as a whole. By law, you cannot and should not take a life to defend property. However, the Home owner stated he was firing at the truck to disable it.
Attempted murder requires intent. The Home owner stated he was firing on the truck. Granted, he could be lying, but based on the evidence that would be extremely difficult to prove.
He was charge Aggravated Assault. I think this was the correct charge based on the evidence and testimony of everyone involved. He is facing some serious fines, perhaps even jail time, and the legitimate loss of his firearms.

I donāt get why rando civilians are allowed to dispense harsher penalties than theyād receive if they were just caught, arrested, and tried. You see, something like this could never happen in either NZ or Australia, where sensible restrictions exist when it comes to the possession of firearms. Even if access to weapons were as easy as it is in the US, something like this would still be very rare, because we're not so anal when it comes to "defending ma propertee". If the facts are as you say, the shooter should definitely be charged with attempted murder. If the person they shot is a POC they should also probably be charged with a hate crime.

I live not too far from where this occurred. Yes, the shooter should go to prison. Tennessee law does NOT allow shooting for the defense of personal property. Even if the homeowner believed delivery driver was doing something to his truck, that does not constitute threat of death or serious bodily harm. The homeowner should have called the police. Or, if he wanted to take some action, yell at the driver from the safety of his porch. At least then the misunderstanding would have been cleared up.
Had it been a home break in, that would be a different story.
According to the linked report, the shooter has been charged with aggravated felony assault, which seems reasonable. It would be very difficult for the District Attorney to get a conviction for attempted murder. A good lawyer could easily convince a jury that the shooter was just trying to stop the 18yo from stealing the truck, not trying to kill him. Even getting a conviction for the aggravated felony assault will be difficult, since the shooter will be portrayed as someone protecting his property, further exemplified by the fact that most of the shots missed.
It's unfortunate, and some people will claim foul, but in the American judicial system, sometimes you have to charge and convict someone with something that will stick, regardless of what you might wish for.
Also, vehicle theft isn't a crime that carries a death sentence. So even if he was trying to steal it, murder isnte wrong response. It's clear the guy was just an angry guy who had been looking for an excuse to lash out since the moment rush limbaugh went live.
Couple things. Firstly he didn't claim he was trying to steal his truck. He said he THOUGHT he was. Now that being established whether he was or not doing that I can follow the thought process however what I don't follow is the skipping from seeing said event to issuing a warning THEN the action. In some states he was perfectly within his rights long as he has no trespass signs. I am pretty sure he is being charged with aggravated assault which is a more than fair charge given the very poor choice of action. Well, I don't think murder would stick, given the premeditation requirement, but yeah, that's exactly the kind of person who shouldn't have a gun. Unless someone is trying to deliver a pizza like the Kool-aid man, by busting through a wall into your house, there's no reason to assume they're hostile.

The way you phrased your question makes it obvious that you have already made up your mind that the home-owner was 'looking for an excuse' to shoot someone.
As it is the home-owner was charged with felony aggravated assault and is on $50,000 Bail. I'm willing to bet that at trial he'll plead guilty and will probably be offered a deal if this is his first offence and no one was injured though the delivery guys truck three hits and the home-owner will have to repair the damage and probably have to cover court costs.
I don't think the defendant just wanted to kill the kid, but a reasonable person would not have done what he did. I think it was attempted murder, but it's unethical for a DA to bring a charge that can't be sustained, so that's why the defendant wasn't charged with it.
There will almost certainly be a civil judgement against the defendant.

Something like this happened in my old neighborhood many years ago, long before the current concerns of shootings. They looked for fingerprints on his car and found none from the guy he shot who was just looking at the cool car in the drive. The shooter was charged and convicted.

Home owner is a foolish man. Yes, he deserves imprisonment. I order food online daily, even though I have anger issues I treat all delivery guys with respect and tip. Having a gun doesn't mean you have the right to kill anyone and make excuses.
The homeowner should be charged or at least banned from ever bearing a firearm again. There is a difference between stealing and just shooting an innocent and unarmed person with no evidence of them trying to steal.
The guy shouldn't have been shooting. But whether or not he was actually trying to kill the guy is unknown. The shooter claims he was shooting at the truck to disable it. At least three bullets did hit the truck. Without more evidence, it boils down to who you believe.
I think attempted murder would be hard to prove. Even aggravated assault might be hard to prove.
The guy needs to do some jail time and have his guns confiscated. You should be ablr to kill somebody if they break in your house but if he was in the driveway he should call the cops. If you make the decision to fire on somebody you have to have the intention that you will kill them.
In US a pizza delivery should check twice the delivery address. However I'm sure shooting someone just because the person approaches your door to ring won't be declared as self defense by any independent and sane judge.

It depends on whether the kid was trying to steal his truck or not.
If he wasn't trying to steal his truck, then no, he should not shoot him.
If he was trying to steal his truck then yes he should shoot him.
That is the moral answer in my opinion.
The legal answer may be different.
But none of us know which case is the truth. That's up to a jury to decide based on evidence that we do not have access to.
