I say Fraud. Inasmuch as some women may believe that a man who lies to them to get sex, or importunes them (pressures them until they say yes when they initially said no) for sex, is guilty of rape/sexual assault, I believe in the same way that if a tranny comes on to you and tries to have sex with you without disclosing that individual's biological gender, that tranny is guilty of (attempted) sexual assault.

I think the law should see it as similar to theft by deception. By definition, you didn't sneak into their house and take their money, but you lied to get it. You also didn't forcibly rape someone, you just lied to get them to sleep with you.

Up until that moment, I assume both people were consenting to the process. If, when the person found out that the other was trans, and they said they weren't interested, then it would only turn into sexual assault if the trans person kept sexually approaching them or even going so far as rape.

If a trans person tells you they are female, but they do not tell you that they still have male sex organs, then it is deception, not sexual assault. You can consent to have sex with a person without knowing their real sex, but that consent disappears if either party says no or backs out.
