I believe in some Islamic countries there is criminal punishment for infidelity.
But honestly this is draconian Stone Age stuff. Not a bad idea in principle but when put in practice things can get real ugly. There are horror stories of female rape victims being whipped in countries that practice sharia law. What if the “cheater” was a victim of sexual assault?
Not sure what horror movie you're quoting, but seems like you forget that you're quoting a horror movie. Movies aren't real. Plenty of horror movies show horrible stuff, like that one scene in Terrifier where Art The Clown is sawing an upside-down naked woman from the vagina down, all while laughing like a maniac.
In an educated first world Muslim country, such as Qatar or Saudi Arabia, both guilty parties of infidelity are sentenced the same punishment of public stoning topped with humiliation from their families. Rape victims are never punished so I'm not sure what gave you the idea that that actually happens. And please, don't use backwater illiterate Muslim countries like Pakistan or Bangladesh as an example
I like to keep the state away from our domestic issues.

It might limit cheating from occurring , but it wouldn’t stop it from occurring people that cheat are still going to cheat , they would just suffer more consequences for their actions depending on the laws that are set in place. Some countries murder a cheater , by stoning them or hanging them or shooting them , so if that was the law in our country , I guarantee cheaters would cheat less unless they are complete dumbasses that want to take the chance of being murdered for screwing someone else. Adultery is still considered a crime in some states if there is valid proof that cheating actually occurred especially in divorce court , whoever cheated in that marriage could be penalized for their actions and not receive what they were hoping to receive when it comes down to money and assets , My ex had an emotional affair with one of her coworkers and my attorney told me with the evidence I have on her , she will barely get shit from me. She won’t be getting half of my money an assets and i w wouldn’t have to pay her alimony , she dig her own grave with that shit.
In some countries, adultery is actually a punishable offense. I know in some Muslim countries, you’ll get punished by stoning/caning if you cheat but it still doesn’t stop people from cheating. Cheaters will always find a way to cheat.
But it does deter it, no? Just the same as police deter crime.
@HawkPerception it does, yes. @Totomato is right of course, that cheaters will cheat regardless, but since it's punishable by law, you're less likely to do so. The stoning is done in public and both parties' families are also notified of their family members' actions, and since these are Muslim countries we're talking about, it's traditional for everyone to still stay in contact with their parents, uncles and aunts, siblings, cousins etc. after growing up and having families of their own. Just the embarrassment from facing your parents again after they find out you've been sleeping with other people is enough to put shame on the family and scar their relationships for life
@BullShark Nice, so it’s a combination of both public humiliation and corporal punishment! I don’t want to sound like a psycho lol but if I’m all for it (only if there is concrete evidence of the betrayal). If this doesn’t deter people from cheating then I don't know what else will.
But I also think some people can find ways to go around this. Polygamy is legal and practiced in some countries. I’ve sadly personally seen cases where the original wife was basically forced into accepting the husband taking in a second wife. In these cases then I would consider the husband to be legally and openly cheating as he didn’t actually have his original wife’s consent/blessing to marry again.
@Totomato of course. Adultery and unfaithfulness is considered a very serious crime in Muslim countries, which is to be expected, as so is having sexual relations with someone you're not legally wedded to, and the punishment is equally harsh for both men and women.
As for polygamy, some may disagree on this, but it's not really the same in Islam. Yes, you're allowed to have multiple wives; a maximum of four, but again, there are conditions. If your first wife (who you're still married to of course) agrees and consents to you marrying again, and only IF you as the husband are willing to treat and care for both of them equally the same way, then it's allowed. Forcing your original wife to accept your second, third or fourth wife is avain, not legal and allowed, but regardless, it's still common in less developed Muslim countries, such as Pakistan or Bangladesh, or some Muslim states in India
@BullShark perfectly explained! I have family living in Muslim countries so I’ve seen first hand how some people take advantage of Polygamy but they went about it completely for selfish reasons rather than how I assume what Islam intended it to be.
I guess some people aren’t born to be monogamous, they just need to find a partner that shares their point of view.
A murder conviction can result in death, but it doesn't eliminate murders.
It won't change anything there's a lot of countries where is it illegal to cheat or even give you the right to kill your cheating husband if you use only hand (China) doesn't stop people from cheating.
I mean the fact that men lose a lot of money, their house, their kids in divorce doesn't stop them from cheating so I highly doubt making it illegal would stop anything just as the fact that bringing drugs in Thailand would land you in jail for 20 years (and their prison are a lot worse than French prison) didn't stop some French people to bring weed for their "personal use".
Making something illegal or having a fear to lose everything do not deter cheater or any other bad person from doing bad things for the simple fact those people are different from normal people and are the kind of person who believe they would be able to always get away with their shitty behavior. So while a normal person who would never cheat or so drugs would be motivated by a law to keep being a good person, the bad one would just don't give a shit and think of themselves as higher than the law / too smart to get caught or just outright believe nothing will happen to them cause they're so "awesome".
Deterred, probably so. Stopped? Definitely not. We already have laws. We have laws that deem assault, robbery, etc. illegal and you face serious punishment. Yet it still happens. Murder is illegal and in some cases pinishanl by death. People still do it. Unfortunately, some people just don't care and don't think laws or rules apply to them. Making cheating a crime so to speak may prevent some from doing it, but it certainly wouldn't eliminate the entire issue and people would absolutely still cheat.

If it'll be illegal , people already don’t get want to get caught. It may just motivate people to learn how to hide them better. It may also increase other types of crime. If someone is doing something they aren’t supposed to, and they have more to lose, they’re more likely to take drastic measures to protect themselves and what they have.
I think you’d also see a decrease in marriage in general. The more negative risks involved with marriage, the less likely people will want to deal with it.💗
We have laws on the books now for those that commit intentional murder in most countries that carry the harshest penalties there are, and yet there are still murders every single day of the year in practically every country. Cheating can be hidden for years if the cheaters are careful so they most likely don't care about the laws, they just want what they want especially if they are in, for example, an arranged marriage not of their choosing. As bad as I think cheating is, I'd rather see the law focus on much more serious crimes like murder, or kidnappings, or rape.
As far as divorce goes it should matter big time. If a spouse is caught in adultery than the other spouse should get a clean break and the cheater should be given a lot less in the asset division. As it is, you can come home and find your wife f-ing another guy in your bed and most states will still require 50/50 of the assets and make the guy pay her alimony. She gets paid to be a whore.

Yep, just as it is with everything.. You give humans consequences for their actions and they think twice.. Of course it wouldn't outright stop it, but if you can't even stop something completely like murder and rape in this world, surely you couldn't completely stop cheating..
Deterred, yeah. Stopped, no. Even the death penalty doesn't completely stop it. The higher the penalty, the more the deterrence though.
Cheating is not a crime in Turkey, killing people is not a crime, there are many refugees around and problematic refugees, damn it, there is no justice in my country.
Yes, but rather than criminal just make it like it used to be with full "at-fault" divorce where the cheater loses all marital property and the victim gets custody of the children.
At-fault divorce is problematic. Sure, the man cheated, but she hadn't slept with him for 4 years. Who's at fault? She neglected her marital duties and he did. She did it first. Does that excuse his behavior? What if she argues she refused intimacy because he didn't court her anymore. Never took her on dates etc. Then he says he never took her out because he was too busy working because she got the family into debt from online purchases. But she only did the online purchases because she had postpartum depression. Etc etc. Finding fault is very difficult.
Adultery use to be a felony. Certain elements of our society have gotten rid of those laws.

Of course. Deterrence is impacted by two things. 1) Severity of punishment. 2) Surety of punishment.
Allegedly the latter is more important than the former, but both have an impact. It seems like a lot of folks misunderstood the question as whether or not illegality would remove cheating entirely when that clearly wasn't the case. Strange.
I would hope so. Unfortunately it would be very difficult to be proven by authorities like the police because they don’t know them personally.

Even if it isn't deterred, people would be put in jail. So they wouldn't be able to cause further damage while they're behind bars.
