What do you think would happen and should it be illegal?

Quick list of common enough illegal things, very often unpunished:

• Driving over speed limit
• Shoplifting small goods
• Parking at the wrong spot
• Smoking THC
• Selling cigarettes and alcohol to minors
• Downloading copyrighted stuff for free

All of this is illegal, yet socially accepted enough.

Realistically speaking though, a country can only invade private life of its citizens if a sufficient amount of its population traditionally believes in gov. So I guess the people of China could be okay with this new law, since their belief in gov is established for good. But that wouldn't work with Irish, Slovenians and Portuguese, to name a few...

It is in some places. You can sue both your partner and the person they cheated with depending on the circumstances.

How do you define cheating though? And then go make a legal definition for it? Is "emotional cheating" count? Does it have to be physical. There are such wide-ranging definitions of what constitutes cheating that you'd have a hard time defining it. Then how do you prove it? I just don't see how it's plausible.

Nothing. If people expected to get caught, they wouldn't cheat even if it's not illegal. It's something you can't really prohibit and also it will never become illegal because, it would take a huge amount of work to enforce that. It's just not worth the effort.

If cheating were illegal, courts would be chaos, lawyers would get rich, and people would get sneakier, not more loyal. You can’t legislate honesty or love. It should not be illegal. Cheating is a moral and emotional crime, not a legal one. Handle it with boundaries, not handcuffs.

I am not in favor of the government policing our morality, especially when such actions would do nothing to deter such behavior. Proving sch violations would be difficult, and the cost would be quite significant. I believe that it would be more effective to provide civil remedies for infidelity, such as forfeiture of alimony and asset division.

I don’t think much would happen. A lot of things are illegal but people still do them. Now if the consequences of cheating meant being put to death it might change some things, but I doubt society is going to all agree that death should be the penalty for cheating.
