It already is as at fault divorces impose some serious penalties depending on where you live. Very very rarely do those slide over to women though. I've heard of a few cases though, like getting a judgement in a divorce where she can't be with the guy that she cheated on the husband with in front of the kids, and getting a video of her violating that means she loses custody, the child support, alimony, everything.
Besides that I've never heard of it going punitively towards women. Most states simply have no fault divorce, and don't practice at fault divorce unless someone went to jail for abuse or something during the relationship, abandoned the marriage or something like that.
Personally I think marriage has become a joke, and if no fault divorce got abolished, with abuse, and abandonment being the only divorce options left that people would only get married if they were serious about it. It's not like modern marriages are arranged, shotgun marriages, or even women being pushed into them when they're pregnant now.
It's a choice for conservative people, and is still treated like trash rather than the covenant it should be.

I do not want the courts tied up trying to figure out who cheated, who cheated first and why. IMHO anyone should be able to end a marriage for any reason, and unless there is a prenuptual, things get split evenly
Honestly I think it should. I had enough of how marriages are declining not just in the USA but in my country too. There are cheaters here too. There was a news about a wife caught coming out of the hotel with her lover and the husband is a known celebrity.
Since marriage is a lot more than just dating where you can break up easily without any legal bond (just girlfriend and boyfriend stage), I think if the cheated on wants to file for divorce, the disloyal wife or husband should receive no monetary incentive at all and instead be fined for emotional damage and destroying the value of commitment, destroying a family if kids are involved.
Cheaters should have to wear a chasity belt for a whole year and only be unlocked for a few minutes for bathroom purposes. Lock away their genitals to where they can't even touch themselves down there

I know a guy who cheated and he lost over 95% of his assets in the divorce even though he was the only one in the marriage who had a full time job so it is punishable by law. They can't jail you but they can take all your money and custody rights in divorce court.
In many states in the US, adultery is a crime and can be prosecuted. It's not often done though.
As far as divorce goes, yes. I believe in AT FAULT divorce and I think if it is proven one spouse cheated that the divorce should greatly favor the party that did not cheat.
This "NO FAULT" stuff where spouse A can cheat on spouse B and then divorce them and get 50% of everything, alimony, the 401K of their spouse... etc. BS on that.
No because what ends up happening is that powerful people would always be above the law. In the Roman Empire it was legal for the family of the person who got cheated on to kill the outsider who had sex with the cheater. But that didn't stop powerful people from basically banging any married woman they wanted to & not having to worry about consequences.
A man should have the right to do whatever he wants to a dude who bangs his wife tho. And the other guy should have the right to defend himself. Guess they used to call it mutual combat.
I don't think it should be because I feel like it is a personal matter and the law should focus on more important matters - even in family topics - such as children's rights in the foster care system for example.
I see what you mean about marriage being a legal contract. To that I would say it's a thing from a legal perspective because it helps to make clear asset ownership and who are the legally responsible adults to a child.

At any rate, yes. Marriage and family are the basis of a functioning society; they are the root, the basic building block. If then someone does something that attacks that cornerstone, that weakens the fabric, then the only sane and reasonable conclusion is that the guilty party should face legal consequences.

This same government infantilizes women via the soft bigotry of low expectations everywhere else in the law, why stop at marriage infidelity? I totally agree with you. If two people agree to get married there should be punnished by law if one of them cheats. That's different from just dating ofcorse but cheating overall is disgusting.
I think instead of punishment, they should reward those who do cheat and who manage to stay married. Give them 1 million dollars with every 20 years they stay married and faithful.

But if a wife cheats on her husband (when he was faithful) then in a just world she should have a lot less weight to push when it comes to making divorce settlements. Same is true vice versa. But itβs usually men who get taken to the cleaners in divorce cases and rarely the opposite.
I think they should be flogged with the husband's permission. And course they should get nothing if they divorce: no alimony, no assets other than what she brought into the marriage, no child custody or support, NOTHING!

That would be a very bad idea. Things are already difficult enough in case of divorce. We're only human, and getting "cheating" punished by law would mean forcing people to spy and harrass each other in order to collect evidence. And by the way, who exactly would be allowed to file a complaint? A neighbour or any citizen suspecting someone of having fun outside wedlock? Come on folks, it's high time for humans in general to grow up and mind their own business.
Marriage isn't always about love though man. You cannot define someone's marriage and sexually life.
