The reason race was brought into this is because law enforcers often tend to give black people and minorities in general harsher sentences compared to white people. For example - Just recently this year a white girl stabbed her boyfriend with a knife over an argument and walked free with no criminal charges. Would this have happened if she was black? Of course not.

I said yes that it was fair when I just read rapist (didn't read rape by deception). If he had stabbed his rapist only a few times just to escape and then called the police, that is responsible force used in self defense. However stabbing his rapist 119 times definitely turns it from being self defense to murder.
Once I reread the thing, I saw that he was "raped" by a trans woman, but he was consenting the entire time (not even in a way that would have caused him harm like stealthing). He over reacted in a way that could not be classified as self defense.
What she did may have been a bit scummy by not telling him up front, but he was not in danger so self defense isn't an excuse. As far as I can tell this sounds like either second or third degree murder which forty years seems like a reasonable punishment (I don't think race would (or should) have anything to do with this).
Yes, he deserves going to prison because he stabbed a person because of revenge and not because of self-defense; something that's unnecessary. Even if it was self-defense it was still not justified because of the amount of stabbing. In self-defense you're supposed to defend yourself, not kill someone.
The second thing is that he voluntarily had sex with a person without doing research first and there's a risk of having an one night stand. The trans woman should off course tell that she's transgender earlier, but there's still not an excuse for killing someone in my opinion. If you don't want to be fooled you should try to do more research first. So the killing was a cold-blooded kill.

Well, I don't think it's a rape actually, it's just a misunderstanding that leads to a murder. Though he's straight and that girl is a transgender, I don't think he should kill her for 'having fun' with him without him knowing the real truth. Why didn't he just try to resolve this problem nicely instead of killing his dating friend senselessly? I think he should be jailed, but it's too much because as the matter of fact, it can be an act of 'deceiving' because that Hickerson only wanted to be with a girl who was born as a girl, not a trans--I conclude this because the statement that says she told him the truth after making love, I think it would be better if she told him firstly. That Hickerson maybe felt like he's trapped, but still, he is also wrong no matter what.
I'm sorry but this doesn't classify as rape in my opinion. He was a willing participant and wasn't forced, yes under the pretense that this person didn't inform him of their op I get he would have refused but I am firm in my belief of being careful what we label rape. It isn't just because he's male either: I'd feel the same if he was female and the roles were reversed.

i'd say yes they should go to prison but hopefully the sentence comes with the potentially of parole for good behavior. while obviously the rape is horrible and should be punished; however, killing the perpetrator in such vicious fashion must also be punished
He absolutely should go to prison. It was murder, but I think the circumstances should be taken into account for his sentencing terms. Like I don't feel he deserves life in prison or even 10 - 25 years. Maybe 5 - 9?
But to be fair this is no more rape than a guy lying about who he is to a girl and her having sex with him, because of who he said he was. Like if a guy lies about being a celebrity and she has sex with him, because she thinks she can get famous. It's fucked up all around, but it's not rape. Maybe there needs to be a new law put in place about disclosing your gender beforehand similar to STD's. You can sue someone for not telling you beforehand if you later catch something and you'll win in court over it. But turning around to kill the person is just unacceptable. Had it been actual legitimate forced rape, then that'd be a different story. This is more comparable to being Fraud.

My first thought is how the hell did he not realize that she was a man. all he did was put a wig on and some makeup it obvious. second I feel like if your tell someone your trans after you get sexual you deserved to get your ass kicked. if it was me I would have put him in the hospital but murder is crossing the line. Yes, it was deception and the guy calling to be a woman should have definitely been punished for it - but is by no means comparable to rape.
And even then 119 times is completely out of it. Its one thing beating someone in a rage, but think about how much you need to invest to stab 119 times. That's like 5 minutes of continuous stabbing (!).
He was not raped. Even if we took him at his word, he murdered this person in cold blood. I can't get with LGBT issues. But this was murder. He could have just kicked this guy's tail.

Ya deffinity just because she used to be a man doesn't mean you didn't willing have sex with them in the first place so I don't see how it's rape and secondly you attacked someone who was no threat to you by stabbing them 119 i think he's getting of easy escaping the death penalty his argument is basically I went to McDonald's and they gave me a chicken burger instead of a big Mac so I stabbed the cashier 119 times
He didn't need to kill her. Especially after the deed had been done. He deserves to go to jail. He murdered her in revenge and not in self defence. And that isn't legal.
I don't think the legalities are synonymous with rape. I'd have to see the specifics of the case. But, 119 times? Just imagine that for a second. It's pretty insane. He probably won't get all the 40 years due to plea bargaining.
Welp, I don't think it matters an ounce the race of said person, but stabbing 119 times is absolute overkill and would never hold up in court as self-defense, even if it was undoubtedly rape. So yeah, jail seems inevitable.
