Landover, Md., February 2, 2021 — The Epilepsy Foundation and its partners call on the Biden Administration to rescind a demonstration announced by the previous administration that would severely limit access to anticonvulsants (also known as anti-seizure medications) for the 1.1 million Medicare beneficiaries living with the epilepsies.
On its final full day, the previous administration announced a demonstration program that would enable Medicare Part D plans to opt out of the Six Protected Classes policy starting in 2022 (with a delay for one of the classes, antiretrovirals, which would start in 2023). Medicare’s Six Protected Classes has broad bipartisan support and was established to ensure that people with particularly vulnerable health conditions, such as the epilepsies, have access to the full range of treatments approved by the U. S. Food and Drug Administration (FDA). Under the demonstration, Part D plans would no longer have to cover all or substantially all anticonvulsants and instead, could cover only one drug per therapeutic class—which is even less than Part D’s standard for non-Protected Class medications of two drugs per class.
Epilepsy is a spectrum condition with a wide range of seizure types and seizure control varying from person to person. With advances in genetics, imaging, and mechanistic understanding, a growing number of people are known to have a rare form of epilepsy.
“Given its complex nature, epilepsy medications are not interchangeable,” said Dr. Jacqueline French, Chief Medical and Innovation Officer, Epilepsy Foundation; and Professor, Comprehensive Epilepsy Center, NYU Langone Health. “If people with the epilepsies do not have access to the most effective anticonvulsant (s), their risk of breakthrough seizures and related complications — including injury, disability and even death — vastly increases.”
Weakening the Six Protected Classes policy will also result in higher costs to Medicare, as epilepsy-related medical costs associated with uncontrolled epilepsy are two to 10 times higher than costs associated with controlled epilepsy.
“These classes of medications were protected for a reason,” said Amy Brin, MSN, MA, PCNS-BC, Chief Executive Officer and Executive Director, Child Neurology Foundation; and Chair, Epilepsy Leadership Council. “Allowing Part D plans to so drastically restrict coverage of anticonvulsants is dangerous and potentially life-threatening for people with the epilepsies.”

OK, so what exactly is your point then? Maybe I am confused and misinterpreting you... Do you agree with what AES and these others in the epilepsy community want or not?
It sounds to me that Biden is on your side if anything. This is what YOU wrote (which looks like you copied it):

In short, Trump Administration policy could restrict access to "vital treatments" for epilepsy. The Epilepsy community wants the Biden Administration to reverse it.
Well, I think that's the point, I think. At the onset of 2021, Trump was still president and his administration wanted the policy that the AES is against. That's why they want Biden to reverse it.
I'm not going to attempt to unscramble this particular issues.
As someone who will be getting Medicare soon, I know enough about it to know that VERY few people understand this stuff. I know a lot of very intelligent people who have spent dozens, or even hundreds of hours studying this stuff, and still not understood it fully.
I'm only just starting to seriously research Medicare, because it's going to be forced on me soon. However I've been listening to people a little older than me for some type now, and know this is extremely complicated. I highly doubt if anyone answering this question understands it.
First of all, Medicare is for old people, with only a few special exceptions. So any affect on children will be very minimal, maybe none at all.
Medicare is not a giveaway welfare type of program. You pay into Social Security and Medicare your entire working life through payroll deductions. With Social Security, what you receive is proportional to what you pay in. If you get Social Security, Medicare is automatic when you turn 65. If you don't want it, you have to opt out.
Part A of Medicare is free (or I should say you already paid for it). Part B, C and D are optional, and you pay extra for them. There are some exceptions, which I don't understand yet. Part D (the one in question) is for prescription drugs and did not even exist until recently. In other words, this entire debate is about something that did not exist at all until recently.
Part D is entirely optional and costs extra. I *THINK* Part D is provided by private insurance agencies, not the government. A large amount of Medicare is like that. The government has a complex set of rules governing the hundreds of third party plans offered to Medicare recipients.
I'm still a noob when it comes to this stuff, but I think those complex rules govern the MINIMUM that is offered for these plans. I'd be surprised if they regulate the maximum.
As I said I'm not going to try to unscramble this particular issue. I suspect the drugs in question fall into the minimum category, but that does not mean they are not available. When signing up for Medicare you choose between hundreds of options. I'd be VERY surprised if those drugs in question were not one of those options.

Well, it would be medicaid for children and people under 65. I use it for my epilepsy drugs, my retirement does not count as income, so why pay for insurance?
I get it from a financial standpoint, anti-epileptic drugs are very specialized and expensive. Also typically much cheaper and easier to get if you get them prescribed for anything other than epilepsy, like right now I take 3 different medicines for epilepsy, but all of them are for anxiety and insomnia to skip the copay and insurance pre-authorizations.
Compound that with a problem that you yourself have had to experienced by now, drug tolerance and the need for combination drugs through trial and error. I had a long time where I had no insurance, and oh boy, they are expensive as all hell. I'd say it took about 20-25 different drugs to get to a good combination where I'm at today, and all those worthless ones still had to be paid for until figuring out what drug was ineffective, to what dosage, on and on until finding a winner that one day won't be effective anymore.
There is also an expectation that one day you'll just grow out of it, as the majority of epileptics are youths, and adults are a smaller amount... whether it's because they grow out of it or die accidentally, I don't know, but the numbers support the idea that you can grow out of it, so it's a common expectation.
Anywho, that is concerning as then I'd have to pay for my prescriptions, but not so unexpected. It beats the hell out of the years and years I simply couldn't get insurance to begin with.
I don't know, why would a guy who named a charity after his dead son, use that charity to enrich himself and not give a single dime to actual cancer research, the very thing it is claimed to be for and the very thing his son died of? Well there is a thing within the law that say that things that increases the national deficit trigger automatic spending cuts. In this case increasing covid relief triggers an automatic cut to medicare because the economy and budget is so fucked up after Trump that EVERYTHING is over-budget. The only way to get around this is if you vote on it.. which Republicans are blocking.. So in fact its Biden who is increasing the spending on covid relief and Republicans who are preventing Biden from stopping a cut in medicare.
