The husband is the presumed father. In particular the father on the birth certificate is the biological father where I am. I don't think the nominated father has to sign and would think the mother can just nominate.
In particular the law takes the husband as the biological father if the birth occurred during marriage.
Regardless of the fact the woman was raped it is possible the husband is the father. Perhaps the woman was reluctant to terminate the pregnancy - it will be her child nonetheless. If she nominates her husband as the father then he would have to go through some legal process to cease being the biological father.
Obviously DNA testing would be sufficient to prove or disprove that. It would depend on the jurisprudence if the husband can get himself of the birth certificate. I wouldn't be surprised if it was difficult in some places as some nominal fathers (who never had sex with the girl in question) have had no recourse.
I think it all depends on the jurisprudence is the only answer. Where I am you just need a DNA test to remove your name as father from the birth certificate. You don't need a court order.
The courts will someone to pay and if the rapist is unknown, very likely the husband will have. Of course, that is wrong and courts know it is wrong. However, those corrupt evil judges, are not interested in doing the right thing if it goes against their agenda.

I don’t think most men would really mind it and raising the child as his own. Now if nobody knows who the rapist is that’s a serious problem. Yes the rapist should be paying money. He should be sued and forced in court to pay restitution.

I wouldn't be surprised. I have heard of cases where men are forced to pay child support, even after proving the child isn't his.

But yes it would be in the best for the child if the husband paid. But he shouldn't be forced or shamed for not wanting to support a child that isn't his. People should be angry with the rapist for putting that kid in that situation.

If you know that this baby belongs to an unknown rapist, NOT the husband, you should of course blame the rapist for the child starting life at a huge disadvantage. It doesn't matter if you can't put a face to the rapist.
