they should ONLY if they didn't pass tariff fees on to the consumers OR if they intend to use the money from any settlement to reimburse consumers

I am a person who had UPS slap a $200 tariff on a purchase. if UPS were to sue and win a suit against the administration i'd expect reimbursement

Why? There is no law against UPS hiking prices due to higher taxation.
The tax payers who had to pay the tariffs in higher prices and then have to pay taxes to compensate for tariffs to companies voted for this as a collective.

"The tax payers who had to pay the tariffs in higher prices and then have to pay taxes to compensate for tariffs to companies voted for this as a collective."
NO I didn't vote for this

there is no law about increasing prices but there are laws about charging a tax to customers if there was no tax incurred or the tax is reimbursed by the taxing party (the US gov't). if you (a company) sue for the higher prices you passed on to customers you should reimburse those customers. otherwise you've just gotten free money.
      ex.
      shirt cost $20
      tariffs are $5
      you charge customer $25

you sue the government for the $5 tariff and win the $5 back. if you don't reimburse the customer you passed the fees on to then the company has made $10. $5 off the government, $5 off the customer

No. 5-5+5=5 They would make 5 $ from just the customers while government would just return the 5 $ company paid for.
Some company can sue a importer but we'll see how that goes.

@Pohjolan i already said this... but if the suit goes their way they get the $5 bucks from the government and keep the $5 they collected from the customer... THUS they earned $10 extra dollars.

so why should a company make $5 in tariffs if they were remibursed the tariff? and to be clear it wasn't a simple increase in price, it was priced as a tariff. it's even listed on receipts... i literally have the email saying i am paying extra for the tariff

i'm going to be done with this convo cause it's rather clear you don't know what you're talking about. do a lot more research without your bias and maybe you can have a educated convo on the matter

Do you have intellectual disability? You don't make 5 $ if you borrow someone 5 $ without interest and later get 5 $ back.
The companies only get the money they charged from the customer to cover the money they borrowed US government.
If you consider this a unethical arrangement then you can blame Trump.

Let me explain. You and Bezos have one apple. Bezos lends his apple to Trump and gets one apple from you. Later Trump returns his apple to Bezos so he now has two apples. At no point will the two apples turn into three apples.

@Pohjolan "you and bezos have one apple" the beginning of the flaw in logic. Bezos isn't sharing apples with anyone dude. Bezos isn't lending the apple to trump, he paid the apple to trump. if a court comes in and says the paid apple was illegal and must be returned. the apple still was never borrowed, it was paid until a court mandated it be returned.

BUT I still paid an apple to Bezos, because Bezos had to pay an apple to trump and passed that cost on to me. When and if trump returns the apple Bezos paid, Bezos now has his apple paid back, and the apple i paid him so he has TWO APPLES in the hand

you just need to accept your logic is flawed my friend. please stop this
      $100 Adidas soccer ball
trump tariffs all germany imports 10%
so when that ball is shipped via UPS it cost UPS $10 to bring the ball into the country.
UPS passes that $10 cost on to the purchaser of the ball, to cover teh $10 they lost
but the supreme court comes in and says the tariffs were illegal
no UPS sues the government to return the tariff money.
If they win, Gov't gives UPS $10. Now UPS has the $10 they paid, and the purchasers $10
the purchaser is out $10. UPS has $10 they paid, plus the $10 the purchaser gave them.
      THEY OWE THE PURCHASER $10

Its practically a loan. Trump knew from the get go that this was illegal.
They companies only made 10$ from that arrangement.
Good luck trying to find a law that they owe the purchaser 10$. Its not like they are obligated to drop prices after tariffs are back to normal.
If the competition does it then they will too but higher prices might be the new normal.

@Pohjolan taxes are based on implemented local, state and federal laws. if you charge someone a tax based on an illegal law, you've illegally taxed someone

so you should be asking, is it ok to tax consumers for a non-taxable item. the answer is it is 100% illegal

They were free not to purchase things such as food or medicine.
Importers were not free not to pay a tax on the basis that it was illegal.

Seems fruitless given Trump is slapping tariffs on nations for national security purposes to protect domestic industries deemed vital for national defense and economic stability. Given that we are headed in that direction with military tribunals to come and martial law in certain cities a declaration of a national emergency could very easily be used to seize the means of production. If they are not serving the goals of the country and they refuse to cooperate with the federal government they could be taken over. It's not the time to go to war with the federal government.

We, the public, still get fucked. WE, the public, paid for the increased costs past on to us BY corporations like FedEx. They just passed on the tariff costs to us in the form of increased rates, but now THEY'RE going to get money back from the government? What about us? WE paid for it!1

You see, I told you dumb fuckers... it's all a grift !! WE paid for the tariffs, and now the corporations are going to get RE-PAID for the increase they already charged us.

If the Federal government started looking into how these companies treat their employees they might find themselves in a world of hurt.

It's double-dipping. Fedex and other companies have already passed on the stuff cost to their customers. They have no losses due to tariffs, no damages, to recover. A lawsuit is a waste of time and money... Only the lawyers will win.

@Pohjolan I would never contend the tariffs were legal, since SCOTUS says they were not. SCOTUS left it up to the lower courts to deal with reimbursement, which I personally think they will fail at. How will any company be able to clearly identify what the illegal tariffs cost them, versus the tariffs already in place? And if they passed on some of that to their customers, who paid more, how can they claim a specific damage amount to be successful in any lawsuit?

Personally, I believe it would be best to forget about reimbursement, and think Trump is right. Any reimbursement suits will be tied up in court for years. Only lawyers would get any money. Let's not do that, huh.

If they are not reimbursed then the supreme court is wrong and it is actually legal.

"How will any company be able to clearly identify what the illegal tariffs cost them, versus the tariffs already in place? "
You do realise they have accountants and the tariffs approved by congress are public information?
"how can they claim a specific damage amount to be successful in any lawsuit?"
They don't have to prove any damage. Just that they were taxed illegally.

" I believe it would be best to forget about reimbursement, and think Trump is right."
If you bothered to read the law you would see that the supreme court is right and Trump is wrong.
"Any reimbursement suits will be tied up in court for years."
It might be the next government that has to raise taxes to pay for Trumps loans.

There is no guidelines for returning funds from tariffs. The Supreme Court needs ot step up and deal with a problem that they created. By the time it gets settled the new tariffs that were imposed last week will have colleccted enough money that it will cancel out these tariffs anyway.

No, foreign countries are paying for this. Even though democrats are claiming that to American public is paying, the inflation figures tell a different story. They have held steady since the beginning and recently went down a little more. The trade deficit has also decreased because of fewer imports and more exports. Apple is building a factory in Texas ro build Mac computers in the USA.

      No not exactly.
I'm sure if you check any of your imports from any country all over the world they have increased double digits.
The American people are really paying the tariffs, not companies.

Are you kidding? We have a global economy whether you like it not! America can't make EVERYTHING! It's not 1950... it's 2026! Have ever heard of "Amazon"? Where do you think Walmart gets its inventory from? Stop being delusional! What about the foreign car manufacturers who have plants here and hire AMERICANS? Blaming American consumers is a lame ass deflection! Trump has a long, long history of tanking businesses and screwing employees! How in the fv<k do you bankrupt a CASINO? WTAF? What happened to Trump University, Trump steaks, Trump Bibles, Trump golden shoes, Trump Mortgage, Trump Airlines, GoTrump com, etc? He's a grifter and a con artist... and he has an army of dupes and suckers following him! PATHETIC!!!

So, why did Trump do this in the first place, if he knew American consumers would be getting screwed?

Because the reality is Trump is no different from any other politician. It doesn't matter if they're blue or orange Democrat, Republican, conservative, liberal.. .. they're all the same.

Side note it's actually quite humorous to watch people argue over which politician is better than the other.

Tariffs were put in place for one reason and one reason only; to tax the people more
