Castration for pedophiles?

Any legislation would be irrelevant. It would clearly violate the 8th Amendment.

This is what would happen...

Suppose the state of Pennsyltucky (PY) enacts legislation for the castration of any "penile person" convicted in 2025 and later of child sexual molestation. Let's call this bill PY-2024-1, "The Make Our Kids Safe Act".

The ACLU and Lord knows who else is INSTANTLY (I am not kidding about the speed) going to file a lawsuit (ACLU v. Pennsyltucky) in the US District Court for the District of Pennsyltucky ("DPY") that PY-2024-1 violates the 8th Amendment which is:

Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Furthermore, the ACLU will ask the District Court to enjoin PY-2024-1. ("Enjoin" means that the Court is saying that, for now, the law is not to be carried out.) DPY will enjoin PY-2021-1 until the case is resolved.

So, it goes to trial - it'll be quick - and DPY will issue the opinion that PY-2024-1 is unconstitutional as it violates the 8th Amendment of the United States Constitution.

The State of PY will then file for a "writ of certiorari" to the US Court of Appeals for the [N] Circuit ("The Nth Circuit") claiming that the DPY District Court erred in their opinion and that it should be overturned. The Nth Circuit will issue a simple 1-sentence order like this:

ACLU v. Pennsyltucky: The petition for writ of certiorari is denied.

If the State of PY tried to elevate the issue to the US Supreme Court, they, too, would be rebuffed with a similar order.

And that would be it. A castration specified by PY-2024-1 is so clearly a violation of the 8th Amendment that the law would struck down immediately. FURTHERMORE, there is no equivalent for "vaginal persons"! Thus, PY-2024-1 would also violate the Equal Protection Clause of the 14th Amendment. To avoid violating that, PY-2021-1 would also have to have a mandatory oophorectomy of both ovaries for a vaginal pedophile.

Again, it really doesn't matter. Such a law would be so unconstitutional, no court is going to waste its time and US District Court would give a summary judgment for the plaintiff ("ACLU" in this example) thus striking down the law.

That qualifies as cruel and unusual, i think. While it feeds out primate brains' bloodlust to exact revenge on shit people, taking steps to feed our primate brains' bloodlust is stepping in the opposite direction of civility. And if our response is "if being civilized means I can't hurt people that trigger me then I don't want to be civilized," fine, but we need to get that out in the open so we can come to an honest consensus on it.

Years ago, there was a big prison in Florida I believe, and when it was time to get out, all of the pedophile prisoners were begging to be chemically castrated before getting out. They said they didn't want to liveife as a pedophile, and wanted to change so they don't hurt anyone anymore.
But the prison said NO to these men because they said it was inhumane. Can you believe that?

I can believe that the prison said no (not interested in actually helping anyone just detaining) and chemical castration I don't believe is permanent like its not just 1 or 3 or 5 injections I think the treatment lasts as long as their alive and if they stop the treatment they revert back to creeps so I totally agree with it as for those few innocents that get wrongly accused charged sentenced castrated and then found not guilty they wouldn't be mutated and should be able to return to some sort of normality if treatment is terminated so definitely

Because the rule of ethics is that is has to apply in reasonable situations, how do you then castrate female paedophiles of which many exist? There is chemical castration where medications are taken to prevent arousal, which is a common practice; however, the individual has to take them and want to take them.

The documentary I saw said CHEMICAL CASTRATION. That's different than surgically removing anything down there.
In the documentary I saw they made it sound something they do once and it's over. They begged for it.
Never did I hear them mention it would be something that you'd have to do repeatedly.
This is an old documentary so maybe they did different procedures then they do now.
How else would I even know about CHEMICAL CASTRATION if I hadn't seen a story about it?

@sage2021 I've heard about it years ago but, I don't think it's gonna stop anyone from screwing children. It'd be like arresting school shooters and then releasing them with less powerful bullets. They can still go into schools and shoot people but, using weaker bullets will bring down the murder percentage.

Same with rapists. It would just make them angrier and they can still rape people with objects.

Provided they are guilty without a shadow of a doubt. That said- I believe they do in some places, not sure how effective it is. But some the most dangerous aren’t doing it for just sexual pleasure, it’s more of a power thing.

It wasn't a punishment for the pedophiles.
These were pedophiles that had done there time and we're about to be released back into society.
Each one wanted to be chemically castrated to prevent them from being a pedophile again.
But the prison said NO. So they got out of prison the same way they went in - a pedophile.

DNA, cameras, eyewitness etc - honestly we should just put anyone accused of rape under lie detection and stop putting victims under trial as much especially if they're a child - in a lot of cases of pedophilia, it's someone you know, so cases like that are more likely to have DNA as well

Anyway, there's too many questions and too many variables. But for the ones that rape children of course they should be locked up for 20 or so years. I mean, that's a fairly brutal punishment given the kind of sorts who frequent prison and their feelings towards paedos.
