Also, Noem is representing the administration AKA Trump so much of those comments in regards to "Color is neither a poison nor a crime" is referencing to public statements made by Trump as to how it gives context to actions taken by Noem.

So since Trump has openly been racist on this subject it forces the judge to label Noems actions as motivated by racism in the absence of other justifications.
