I am on bail currently after being arrested for failure to provide (breath test/drink driving).

I was very cold and hungry. It was 4am. My Google maps were not loading and I was in a city I don't know so I was pulled for driving too slow (I was hoping maps would load as I didn't know which way to drive).

I will be punished but I'm hoping I have mitigating circumstances and have requested cctv footage to show I did tell officers I was cold and visibly shaking which impacted my breath on the test. As they keot saying I wasn't blowing into it long enough.

I don't entirely understand what you are saying. Were you drinking or not? How slow were you driving? If it was super slow, you should have pulled over until you got your bearings.

I don't know what criteria they use to suspect that you've been drinking. Driving super slow would probably be a legitimate reason to suspect you. You need to talk to a lawyer, but my guess is that if the cops have a valid reason to suspect you were drinking, you need to do the breath test. There are some judgment calls here, including why they suspected you, and why you didn't blow hard enough. The judge will tend to side with whatever the cops say as long as it sounds reasonable.

This is serious enough that you should get a lawyer. Even if the cops had very good reason to suspect you were drinking, you might get a plea bargain to a lesser charge. You can try for a plea bargain yourself, but paying a lawyer will give you a much better chance of success - because that's how the system works.

I had drank but I wasn't sure if I was over limit or not as a couple hours had passed and I felt ok. I was driving slow because I was trying to do a good deed when someone asked for lift but I don't know the city and I was asking them for directions but they didn't say so i was going tp pull over but that's when police pulled me for unusual driving.
Then as I was dressed in club gear and smell of alcohol in car they wanted to do the test.

I get a free lawyer on the day. I did phone around a few lawyers but they are too expensive. More expensive than just paying the fine. So I'd rather risk paying it than paying a lawyer and still paying it.

Just use the free lawyer. Have they mentioned a plea bargain? It sounds like the cops had reasonable cause. You are probably required to do the breath test. I don't think being cold and shaky will make any difference, but maybe the lawyer can do something with it.

You will probably end up paying the fine. Even worse, it will go on your record. Refusing a breath test (which is how it will play out) implies that you were drinking. Refusing the test is a common way to get out of a DUI. A lot of people say that is what you SHOULD do. And the cops know that. They know the game.

Unless you only had a couple of drinks, you were probably over the legal limit. You got busted. If the lawyer can't do anything for you, just bite the bullet and pay the fine.

In general you need at least an hour per drink for it to mostly leave your system. Better to wait a little longer. So if you drive sooner than that, you are taking a chance.

Was two hours before tested since last drinks but I don't know.
I did do wrong so ill accept consequences. But I was cold and told them it was affecting my breathe. And they didn't ever give me blanket until after test said I was OK. I never refused test. I tried 6 times. But I think cold and fear of failing did effect how o did it. I requested cctv footage so I can review what I did and said and make a case. Fingers crossed they at least go lenient.

I have been arrested more than a couple of times, once under suspicion of driving whilst over the prescribed legal alcohol limit , so kinda the same as you , I was pretty adamant I wasn’t over as I had only consumed 4 units of alcohol over 2 hours previous to my arrest and did think about refusing to provide but that’s seen as an attempt to obstruct justice and hide intoxication so I reluctantly provided and to my horror I was over and subsequently charged at the roadside. Arriving at the police station I was booked in and then immediately taken to provide an evidentiary sample where I blew 34. I was then un-arrested and charge dropped and given a caution that I was “lucky” it was a 45 min drive to the police station from where I was picked up. From that point on when driving I abstain from alcohol when driving completely.

Ohhh. Yeah that sucks. I had had a couple drinks but not for a couple of hours and I didn't know if that would show up so I got scared. But after the drive to station etc that brought me a couple more hours then I blew 33. It sucked not having my phone to look up advice. But actually... punishment would have been worse if I was over rather than "obstructing" actually. So I think I did right thing. Punishment either way. But lesser because I was clean once test did work.

Yeah the machines they use at the roadside can’t be used in evidence as they are not kept calibrated and are only to be used as a guide so it makes no sense to flat out deny giving a sample. Your fortunate they gave you the option of blowing again at the station , they didn’t have to do that perhaps they understood your nervousness or recognized that you may have had difficulty before or maybe you just have an innocent looking face 😇. Either way I think the time in between , like mine , done you a favor. The 2 that arrested me went to Macdonalds on the way back to the station , I got nothing because thu can’t allow that but I think they were deliberately trying to waste time to help me.. but they would deny that obvs

We are almost immediately extracted both occasions by friends with political powers who owed us huge favors.

i'm not sure if i was technically arrested or just taken in, but if it counts last year i got really drunk in public and had the cops called on me. they took me to the station and i spent the night in the sobering up cell.

I've never actually been arrested but I was taken to the cops station with my ex-boyfriend because they were looking for drugs (my ex) at my house. It was pretty scary, because they are like 11 cops with weapons look like going to arrest some terrorist. But they let me go home in hours after test and interrogation.

Aww yeah that sucks. Luckily here police don't carry guns or anything. But it is kinda horrid that even if innocent they have power to charge u if they wanted.

Because my ex had a lot of drugs, but i was clean. That’s why they let me go home and only arrested him.

Yh I know. But it's always risky. My abusive ex used to say he had class a drugs in house and I'd get done as well as him if i called police on him to get rid of him. It's foolish. I shouldn't have believed him. But at time it stopped me ending things sooner. In end I did call police eventually and he ran away and I searched my house (and later moved house) and never found anything so probably rubbish. But he did sell weed so I couldn't be sure.

Yeah, it was for a 3 car tragic accident, which I caused.. The third car was alright, but the car I was driving was totaled, and the one in front of me was badly damaged in the back..

But yeah I was only there for an hour at most since my record was clean.. I ain't trying to be a stereotype.. Lmao..

I never been arrested and I feel I won’t. I try to follow the rules and I make sure I don’t get in situations that could get me arrested. I have been pull over either from driving too fast or not driving correctly but nothing to bad.

Nope. When I applied for a job several years ago, the company ran a background check on me. They were amazed at how clean my record was, not even a parking ticket in the last 15 years.

I might get a lot less. Being first time offense at 46. But I rather prepare mentally for the above so I'm not like devastated when I get it. If they say £800 fine and 3 months ban I'd actually feel like celebrating lol.

In the states you practically have to kill somebody to get your license suspended. Most of the State legislators are attorneys and they make a lot of money on drunk driving cases so they will not change the laws to protect the public.

I've requested footage from police but they are sneaky. They gave me court case in three weeks but "can take one month" to get footage.
I am putting my own case together so I can hand it over easily to free solicitor who won't have much time to build a case him/herself. I just hope they actually want to win and is not a open shut case for them with getting paid anyways. I think I have a good chance but I'm a pessimist. I always prefer to prepare for the worse and be surprised than hope for the best and ne devastated.
