The Chief Magistrate, Mr Davis, acknowledged that there was "no identifiable victim", no pre-planning and the pair were clearly under the influence of drink. Hirst pleaded guilty to the offence of 'outraging public decency', and Smith was found guilty of the same offence in his absence in September. Magistrates in Scarborough said the couple were "very close to going to prison". When sentenced earlier today, the couple were spared jail, but were instead handed 12-month community orders, and told that they must sleep apart for almost six months, imposed by implementing 23-week long curfews at separate addresses monitored by electronic tags.
