      Minnesota Supreme Court ruled it. Maybe there’s underlying issues that would still prosecute rapists. But from what I read they don’t consider it rape if the woman willingly gets drunk.

      Here is how i look at it.

      We are all responsible for how much we drink. This doesn't cover cases when someone was drugged
      We are all held legally responsible for our actions when we are drunk. If we rob a store or drive drunk we are still responsible
      The decision to have sex should be no different.
      If the guy fucks her without consent while she is passed out then that is rape
      If she falls asleep after giving consent and they are having sex then that is a gray area.
