This seems stupid. Everybody was okay with the fact that when a person drinks they do irresponsible things, but now women want to say it's the guy's fault for taking advantage of her while being drunk. Well shouldn't guys be allowed to say the same thing if they drink too much and wake up next to a big fatty girl? Guys get "raped" by fat girls all the time after we get super drunk. What's up with this ridiculous "everything is rape"? What's up with that?

The argument is that a person who’s drunk can’t give consent and as such any sex while sufficiently inebriated isn’t consensual.
This raises its own issues though. What if both parties are drunk and give consent? Were both parties raped? Were both parties rapists? What should this limit be? Should it be.08 like driving? Should it be higher? How do we determine whether or not the person was sufficiently inebriated to not give consent after the fact? Etc
My general rule is that if the person is unconscious it is certainly a rape. If the person is just inebriated and appears to be cognizant it isn’t. How these are to be deliberated is confusing though and it’s hard to determine where a line should be drawn.
Ya I did think of that and it does make sense but the justification for it being rape is —> when you get raped you might not be able to fight it off but if you are doing the raping then you know what is going on. You are coherent enough to plan an action and carry it through —> while she might not even be able to walk. That’s guilty
Not really, considering it was her choice to get that drunk in the first place. If a girl gets drunk and crashed into another person's car do you blame the other driver's because they were in control of their car, but the drunk girl was not in control? If you can't handle your booze than don't get wasted in the first place.
The act of drinking and driving is your own —> you choose to drink and drive. To get into a car and put yourself and others at risk When you drink and get drunk that doesn’t mean she can be assaulted, robbed, beaten, raped etc... those are crimes in itself. So you can’t commit those regardless if she is drunk or not

You and I can wake up to any rape scenario possibility and fight. As long as we think the best case scenario is to fight for survival we would not be targeted. Now think the best case scenario is to do nothing and waking up just to make it another day. This law is not about what is fair between genders, it's about survival and then justice.
As much as we like to think lady justice is blind, we make huge compromises to do what is right. From plea deals to cooperating with law informants.
