A girl asked a question on here. She believes that when the Republicans take the house and senate, they will make all abortions illegal. So she's basically saying that the federal government will make abortions illegal. She obviously doesn't want the federal government to do that. Cool beans.

But when the supreme court just ruled that the federal government needs to stay the fuck out of this issue, the left sent death threats to the justices on the supreme court. They wanted the federal government to make the rules. But now they don't want the federal government to make the rules.

Don't you see how absurd this is? You can't have it both ways. You can't have your cake, and eat it too.

This is why the supreme court exists. And they made a good decision on this. Let the voters decide.
A National Abortion Ban is Coming

First off, no, it won't matter if the Republicans take the house and Senate because the Supreme Court's ruling effectively stripped the issue away from the federal government on the grounds that the constitution does not grant them that power, and kicks the issue back to the state governments to decide for themselves, as required by the constitution. In order for the Republicans to ban abortion nationally, or for the Democrats to force states to provide access to them, the US Constitution would have to be amended, which requires much more than a simple majority. There is no way that the Republicans will have the numbers to do that on their own, and even if they did, a huge chunk of them don't want the federal government given the authority, anyway. So such a bill would be dead on arrival.

This means that as it stands, very little has actually changed. The states that banned abortion outright were already making it extremely difficult to get one to the point that women seeking them were often going or referred out of state anyway, and that is still going to happen.

Regarding an amendment, there's about a 0% chance that an amendment specifically and only about abortion would ever pass, in any context. To give the federal government that kind of power would come with the ability of the government to effectively control the healthcare system in full, which is a far more valuable goal for authoritarians. Frankly Roe v Wade really wasn't all that valuable to the government because of abortions at all, but because it established a precedent in which the government could pass unconstitutional laws based on false claims of "implied" power or rights. The Supreme Court does not exist to create laws, win over, or answer to the general public- its sole purpose is to review federal laws and determine if they are first off constitutional, and second being implemented in a constitutional way.

Even though the SCOTUS reversed the R. v W. decision, the Federal Gov't CAN make a law that says abortion is a form of murder, therefore you can't do that (and possibly include restrictions such as rape, incest, life of the mother, etc...).

Opening that can of worms is something not even Democrats in Taxachusetts or NY would care to touch for fear of getting voted out of office. Otherwise, they'd have already done it by now. There's been multiple opportunities to codify abortion as allowed under (actual) law.

If you even THINK a national abortion ban is on the way, forget it. The left has their heads up their rears. They FEAR EVERYTHING that could possibly mean they can't have their own way. They live on fear, chaos, confusion, doubt, and anxiety, and feed their followers that same crap! WHY... would they protest the SCOTUS decision in places like NYC and LA? In my life, I've never seen a President call the SCOTUS dysfunctional, until the "Vegetable" did it. Dems are more than butt-hurt over Roe. For the past 50yrs, abortion has been their special "baby" of all SCOTUS decisions. No. That's not what they ruled. They only said it wasn't a protected right. They left it wide open for the feds to make laws regarding abortion. By default abortion is legal at the federal level, because if it's not illegal then it's legal. The justices specifically said they did not intend to make abortion illegal. **Not a single justice** wanted to make it illegal. But they did leave it open for Congress to pass laws regarding abortion.

They ONLY said it's not a protected constitutional right. The feds and states can pass all the laws they want. New laws could get challenged also but currently it's wide open.

It’s actually not that far out of the question. The protection of unborn children act is already in place. One interpretation of that could make abortion illegal. It would most likely land back in the hands of the supreme court to decide which life should be more protected in cases of medically necessary procedures. Since we all have the right to life, when two lives are intrinsically connected, which do we protect? That debate isn’t going to douse the flames of this controversy. It’s going to fan them.
