Most people have no idea how schools actually work. Because I have no kids, but am forced to throw away my $$$ on school taxes, I understand them quite well.
Schools don't care if the kids learn squat- if the kid fails, he or she is held back. That's a social disaster for the brat, but that's a problem for the kids psychologist to sort out.
Here is what gets you into trouble... the brat doesn't show up for school. Why? MONEY.
School districts receive state funding based in part on Average Daily Attendance (ADA) numbers. ADA is a figure that indicates the average number of students who attend a particular school district in a school year. ADA is a key number in a formula that ultimately determines how much money your school gets from the state.
Bottom line- so long as the brats ass is in a seat, the school get paid. No brat (or written excuse for an absense... no $$$. The district will send a truant officer out to find the kid and drag then into class. If that happens enough, you're in trouble. Otherwise, no harm no foul.

Don't think so but if your kid misses too much school you can go to jail. There are also major police departments that keep track of a kid's grades and other things to make a list of "potential criminals". Now when your kid interacts with cops they're on that list. They probably get treated just like a criminal even if they're not too.
And why do you think your kid is failing in school?
You cannot really change a child's ability to work at school, only hope to give it some motivation. I am sure no civilised country would jail anyone because their child had learing difficulties.
Seems more a "social services call" in relation to the bad grades to see if they need support/etc. You don't go to jail for F grades...

I don't think there is a law that would make getting bad grades illegal. However it could be "strongly recommended" to the child to repeat that one year of school and could cause suspicions from the social services.
