Should I change my daughter name to my husband own?

My daughter is currently 5 years old and I had her in a previous relationship before my marriage. We met when she was a year and a half. She currently calls him dad and her biological dad doesn't play a role in her life. I usually always need his permission to get certain documents for her and it's literally a quest to find him. I don't want to change her name and then she hates me but I'm trying to do what's best for her. Her biological dad side of the family plays no part either.

It's not about a bunch stranger answering it for me. It maybe has someone out there who experienced the same situation and may have an opinion of what they wish they had done. I did have this conversation with my husband and he's all for it, but I believe having more than one opinion can help a situation. Thanks for your response by the way.

I read some study about how the majority of children whose stepfathers enter their life from the age of 1-5 are considered/called "Dad" rather than "stepdad." Plus, I feel like it just creates more of that family bonding. Because he has been a father figure for already 3.5 years since she was 1-and-a-half, I think she'll see her stepfather as an ACTUAL father figure, like a biological father.

If her biological dad isn't acting like a dad and is completely absent, I don't see the reason to keep her last name. Considering that her stepdad is the one putting in the work to be the father figure and her actual father isn't in her life, when your daughter becomes old enough to understand her last name change, she's probably going to be fine with it or even glad that she took her stepfather's last name. I mean, the stepfather looks like he's the real dad at this point... Why would you want the last name of a father that is completely absent?

I say you should definitely go for the change and just get it out of the way.

He said I can but I need the permission from her biological dad. Considering the fact that he hates my husband most likely we'll have to go through court to get it.
