I'm also not arguing the "legal" stand point of it. She had her picture taken without her permission, remarks made about her and refusal of the picture being deleted and you told her she deserved that, what did she do exactly?

impolite, i suppose, but legal. scotus has ruled you have no expectation of privacy in public places, so unless he uses that, say, in publication or such... legal.
some phones come with a feature that its backlight blinks for notification of messages, mails etc. maybe he received a message or something and you thought he is taking picture. it may be a misunderstanding. so try to forget the incident.

If someone is harassing you and taking your picture without your permission, that is wrong and you absolutely should call them on it.
