Is he mentally okay or the issue is on me?

This guy is 38 years old, never had a serious relationship, never married.

I'm in a situationship with him for months.

Yesterday we had a conversation about our relationship.

So he said 'I'm almost 40 years old, I won't change... I want to be free"

He said we have a "relationship" of some sort, but he doesn't want to commit or get into a serious relationship. And it's up for me to decide whether or not I want to continue what we have.

He said "I do give a fuck about you" and that he doesn't want to break whether we have.

What should I do?

Seems like your choices are:

A) discuss what you want from the relationship with him and see if this will change his opinion.
B) say nothing stick with things as they are and hope he changes opinion at 40.
C) call if an end and look for someone who has compatible relationship goals.

I don't know why you don't bring this up with him instead like literally just ask him that but I shall try to answer I think it's on you not him he told you how he feels you need to respect it or move on
