Did he cheat on Jules then?

In “varsity blues”, when spoiler alert, Paul walkers character gets hurt and basically destroys his chances at a football scholarship, the head cheerleader, Darcy, who was with him in the movie, was never actually in love with him and was really just her ticket out of the small town in Texas. So, she tried to seduce James van der beers character in the movie (having been friends for years), and while they did kiss, he eventually said, no, it’s just not right, I’m not even in love with you. So, he kissed her but he even intended to go all the way with her, which would have implied cheating. Is it still cheating because they only kissed though?
