I think the bigger issue is "what rights will we allow the government to take away from us?" And "what if they won't give our rights back?".

That’s what the Confederates used to justify rebelling against the Union, and you can’t get more right-wing than those guys. I think the amendment you’re looking for is the Ninth Amendment, one of the primary justifications for the Griswold case (birth control) and Roe v. Wade (abortion rights).
