Well, it’s called a James Comey standard. Back in 2016, James Comey said that he would not prosecute Hillary Clinton for her emails because he figured that it would be election interference especially given the time that he would’ve prosecuted her which was October 2016 which would not have given the Democrats enough time to find a new candidate. So he set up the standard, which still applies today that if you hold classified documents in a private server and they get released with some of her emails that and actually ended up in the murder of a couple of our spies but because she did not intend for this to happen on the keyword is intent here it was not a prosecutable offense.

The same thing can be true for Donald Trump, because James Comey, set the standard. Which means that because Donald Trump had hardcopies of Kosovo documents at his house, locked up which no one could get to. This would mean because of the standard James Comey set you cannot prosecute him over those classified documents.

This is why we say on the right that we are living in a two-tier justice system, because Democrats can get away with pretty much anything and not be prosecuted by Republicans cannot. The most recent obvious example of this is Hunter Biden. If you literally you was addicted to cocaine and went in and bought a gun and then your girlfriend at the time decided to throw it in to a garbage can close to high school both you and your girlfriend would be prosecuted to the fullest extent of the law. You might be spending years in prison for it about Hunter Biden because his daddy is Joe Biden gets a couple years of drug rehabilitation. And gives away scot-free if this was Donald Trump, Junior, or Eric Trump they would be prosecuted to the full extent of law.

I’m actually not making shit up this is based on a conservative argument. Jame Comey set a standard of intent he said because there was no intent to Hillary Clinton’s emails to get leaked even though they did which lead to the death of a spy in Iran and Russia. She had classified documents of her own private server. Which she wasn’t allowed to have because she wasn’t the president. But James Comey set the “intent” standard. Had James Comey charged Hillary Clinton back in 2016 this standard would exist. Trump yes had classified documents which he said on Tape 🤦‍♂️ “I could have declassified these documents but I didn’t and I can’t now” which Bring us back to the James Comey Hillary Clinton defense.

So technically both should be going to and be in prison right now. But James Colmey set the intent standard which gets Trump off Scott free because we don’t know Trump’s intent other then we know he likes documents, and he had no intention of classified information to leak.

By the way, I guess it’s been going on for years maybe decades because Mike Pence had classified information Joe Biden had classified information from back in the time when he was in the senate.
