My theory only. The evidence has long emerged that election fraud in 2020 was elaborately planned with a combination of tactics. The SCOTUS attempted to stay out of it back then when Republicans sued. Most claims were never even heard. I think SCOTUS went through self examination and realized they had fukked up. Not only was their decision this time right but their unanimity even with Roberts was a measure of retribution. Their approach to the lawfare will be subtle. They will effectively delay cases so they won't affect the election, making the cases a waste of time and money.

They have stretched the law and shopped for democrat judges to preside over these indictments. They are rushing them through the court and even the one in New York where Trump was denied a jury trial will be overturned on appeal.

Republicans had 4 years to push for more secure elections and have gotten quite a few states to require voter ID and have limited mail in ballots. They have also organized their own ballot harvesting operations. It will be harder but not impossible for the democrats to cheat.

The thing that's important to remember about the whole insurrectionist rule is that it was made after the Civil War to stop people who fought with the south from getting to power.

People back then, it seems, anticipated something like this might happen because of the third ammendment.

The Supreme Court was very careful to say that the part of the case they were addressing was whether or not the state had the authority to make this decision.

A very plain reading of the last line in the 14th ammendment and the third shows that congress must vote on it.

As much as I want Trump to win, I thought congress had to vote for him to be allowed to run, but it seems the courts interperated it the other way around. I think considering how much time has passed since the Civil War, it was the appropriate decision all things considered.

Whether Trump engaged in insurrection or not is going to be a very complicated and long case. Many hours of footage would have to be sifted through, witnesses chosen, strewn, argued over, prepped deposition conducted etc.

The only thing that trial can do right now is interfere with the election and considering how much of a stretch it is to say he's an insurrectionist, bordering on the edge of being absurd especially considering twitters hand in the situation and the governments influence which very likely took place... It's a can of worms that is not worth going into.
