If a girl waiting outside restrooms is flirting with you, you flirt back. You go into mens room to adjust your tie, ad she follows you. The heat turns up, you get aggressive and touch her and kiss and she kisses back, maybe not totally committed... but it goes too hot too fast and she's overwhelmed. she never screamed or yelled, never complained to management... nor did you. Didn't call police. She brags about the event to others, that it was a bit off. She awaits your call. You never called her back... who really knows how she felt.

To me they are different. I've always heard (from women) rape is a violent thing. That was not violent. Sexual assault is imposing on your space, and that might fit.

From what I've heard the events described that he was found liable for, was rape, flat out. But officially it was labeled as sexual abuse. So the lawsuit stands, but only because of a technicality.

Groping isn't rape but it is sexual abuse, forcefully fingering someone isn't rape but it is sexual abuse, forcing someone to give you a handjob isn't rape but it is sexual abuse.
