Changing child's name?

So my son's father isn't in his life as a parent when I gave birth we where engaged but soon after he made it known he was cheating and it was my fault so we separated. I have full legal and sole custody of my son. His dad is in and out regularly. His dad recently married a girl he's known for a yr and they've made it clear I'm the bad guy and keeping my son away out of spite (they skip visitation because the like to travel and otherwise feel to tired to care for him the 24hrs he gets to go over there every other weekend) so whatever... I'm just wondering how I can change my son's last name to mine when the other parent isn't involved (interested) in parenting to save me the constant explanation of why our names don't match with doctors/school/babysitters and so forth when the other parent won't comment on the matter and the new wife is trying to claim rights for having the same last name. Has anyone had success with this?
